I think JB would love to depart this case - he has made his $$$ and become "famous" and could leave without the stress and hard work of a trial. I think he is tired of it all. But he cannot leave with the new law. His demeanor in court is that of a really, really stressed person - I don't think he ever anticipated working so hard on a case. JMO
Yes and scared stiff of not having that $100.00 in his pocket and trying ever so careful not to mess up, albeit the world learns he didn't have $100.00 to his name.:floorlaugh:

I could be wrong on this, but I don't think they would need a separate brief to do that. The departing lawyer could place any such complaint in their motion to withdraw and attach any supporting evidence as needed. The Brief in Support of means that it is coming from someone else. Which is what makes us all think that 1 DP lawyer is resigning and the other has filed the brief in support to say "that's ok I'll take over their duties".

So according to your post, it could be CM resigning and AF stepping up.

It's not JB, no way would he leave.
It can't be CM he is needed cause its a death case
AF will be needed for the penalty phase leaves only one
who is not needed. DS

Denjet, wouldn't Ann Finnell have to agree to step up to the guilt phase with JB because he is not DP qualified? As a mitigation lawyer I don't believe she has to be in the courtroom during the guilt phase of the hearings and trial, but if CM leaves she would - wouldn't she?

Not sure, that's a question for our legal experts ... I would think she would have to take an active roll in the guilt phase ... not sure what having a DP qualified attorney "on the team" means exactly ... obviously, the DP qualified attorney DOES NOT have to be lead attorney as we have seen ...

I think now it is JB, I think the bar is taken early action to have him removed then disbarment will be announced after the trial is over.

I completely disagree. JB isn't goin anywhere.

We may have to wait till morning:

The Orlando Sentinel will pull the file in the morning when the Orange County Clerk of Courts Office opens to determine the subject of the motion and to review a brief supporting that motion.

Whichever attorney it is -- my bet is on Cindy being informed of it when she and her attorney met with JB the Monday before her testimony on Friday, April 1st.

When Lyon quit and when Baden quit ... neither filed a Brief in support of their Motion to Withdraw, giving reasons to persuade the Judge to allow them to quit ... as this attorney apparently did ....

I think CM wants to leave with his reputation among his colleagues (voted best Orlando lawyer of 2011) in tact.

Ouch! Ouch! Could this involve the "GA,falling on his sword"team??? Can't see CM wanting to be involved with this ethical mishap!!! Baez however has no reputation to lose! I could see this isn't worth it to CM:banghead:

BBM, in that case it has to be Mason then, I can't see him doing MORE work - RHornsby has always maintained the defense had done very little work up to a few months ago. Mason seems to have a problem with working Saturdays etc. can't see him doing above and beyond M-F 9-5.

It doesn't have to be the other DP lawyer filing the memo in support but you are certainly right the other DP atty could be filing as you said above.

But more than likely the memo in support is showing "good cause" why the requesting atty has to withdraw. If a DP qualified atty were to leave at this juncture they would certainly need to show good cause and they would need to assure the Court that Casey would still have DP qualified counsel to represent her.

And once/if one of them leave then they're stuck. Completely. Because there is no way in hades that HHJP would let a DP qualified atty leave and have to substitute himself/herself with new counsel that would need to get up to speed.

Depending how who it is that is withdrawing HHJP may not let them leave. I've seen that happen too ...

But to play devil's advocate, Jose was been drowning for a long time, IMO. I am wondering IF, given the current dire financial situation (money until end of April) Baez has been somehow persuaded (or coerced?) to withdraw. I suppose it would be up to HHJP but it just might "save" this case. On the other hand, I could be all wet. I often am! (Just realized my pun attached to "Jose drowning" and my being "all wet.") Unintentional. Just thinking out loud. :cow:

This is also why I don't see them wanting to delay. They want this over with. So, they can all move on. Stupid to look for delays to the enevitable.

If it is DS I would not be surpised, RUN as fast as you can! :back:

Just another thought, but could it be an attorney working on her civil case? I still hope it is CM, but I'm tryig to think of all of the possibilities.

Wouldn't that be filed under the civil case number? .... I hope so ... I'm really hoping Foghorn is the one that's out of there ...

The only thing that makes me think that this is not the case, and it probably is not JB leaving, is in order for JB to depart, KC has to sign off on it. Under the new law she has to agree to it. Not simply know it is happening. I am thinking we would have caught a whiff of it if there was suddenly a lot more activity from the defense team around the OC Jail. I would like to think that they wouldn't do that to her with a phone call.

True, Logicalgirl, very true.

But the rest of the rational world can plainly see otherwise. I just don't know how this charade can be allowed to continue. It is a travesty, and a mockery of our legal system. JMO.

At first when I saw the news I thought, rut roh, Jose's in trouble ... maybe the Florida Bar caught up with him ? Then I thought .. nah ... he's gotten away with his less than ethical dealings so far and nothings been done to him ...
I still think the only way out of it for any of them is for KC to fire them .. JMO
