JB: okay. (smarmy laugh: done with questions) The court did attempt to rehabilitate a pj, you can't rehabilitate...

HHJP: you can't mislead them Mr. Baez. The proper question needs to be asked with the law. If you don't give the law they will give their opinion, I have to interject to let them know what the law is.

JB: this juror lied on his questionaire. He didn't think it was a big deal, by his own testimony...

oh! are you judging HIM JOSE? Is he not someone to be trusted because he LIED???

HHJP: bring him back in.

I'm a bit confused that they can ask about the pot smoking while the cameras and mics are on. That bugs me.

I'm really surprised Baez went with the weed charge; however I am thankful he is playing fair since he let the DUI go.

DT moves to exclude on inability to see age as mitigating.

CJBP schools JB on how he asked the question w/o telling them what the law is--that's the fallacy when you ask the question that way. Need to let them understand what the law is.

Second issue = lied in juror questionnaire re: Pot in TN, intentional, he said he's analytical and thinks things through, he clearly made a misrepresentation of his criminal background.

(State didn't want him but making DT use up one of their challenges.) CJBP denies motion to excuse, DT does not use peremptory challenge on him!
