If they can cite case law that allowed more strikes because it was a DP case, he might have to give them more. jmo and all that jazz

I'm sure there is case law, but they only need to go right to the Florida Rules of Criminal Procedure.

Section 3.350. Peremptory Challenges

(e) Additional Challenges. The trial judge may exercise discretion to allow additional peremptory challenges when appropriate.

Note that it is only at the trial judges discretion. However, it's a gamble to not give them extras because it could lead the door open for an easy appeal based on all of those PJ's sitting in the pool, and HHJP's relentless quest to speed this along.

Does anyone else think this woman sounds like she's trying not to cry?

Especially when she said; "I just feel bad."

Judge will not swear in jury until late tomorrow or the next day because I expect JB to use his 3 back strikes and the state will use at least 3 after DT is done.

They're still stalling because they have no case and they need more insurance than just that one wild card. They want a full hand of jokers. <pun intended> ;)

They only have 3 strikes left. They're going to have to fold either way pretty soon. However, they will have one more objection for the record and it will, once again, be denied.

Someone said earlier that the DT can use all their strikes and ask for more:banghead:

does baez think he can keep striking until....until what? he finds a perfect 12 jury of <modsnip>? that's just not going to happen! it doesnt MATTER who is on the jury! the facts are the facts!

Juror says she honestly doesn't recall much because she really didn't pay too much attention to "this".

This juror seems very honest and almost apologetic that she doesn't know more than she does about the case.

She remembers family & friends saying "how could a mother do that to their child?" She thought the people talking were being casual and those people had opinions that kc was guilty, pj felt those people didn't have all of the info that was needed to make a judgement since it was early (after the child's remains were recovered). She may have said something to that effect to those people @ the time. She doesn't watch a lot of news, she is relating what she recalls.

I think this is what they'll do. Go all the way, as far as they can and then do a plea.

I would have given that a half a chance before they seated that one wildcard juror. Now I don't think there is any chance at all.

I agree, they will ask for more strikes when they are done with these. I also agree they will be denied.

If I was on the Defense Team I would be sitting in deep conversation with my lead Attorney. I would be extremely nervous. I've lost count of the PJ's who have walked in and said Guilty and couldn't consider anything else. They know they don't actually have any "AHA" moments so this is looking very very bad for them and their defendant. IMO

Could it be that JB just wanted to get that objection on the record for appeal?
