2011.05.17 Jury Selection DAY EIGHT (Afternoon Session)

JA explaining that there are two parts to the trial, guilt and then penalty. If you go through the process and you unanimously find her guilty of 1st degree murder, then you come back a few days later for the penalty phase. The state still has to prove certain aggravating circumstances beyond a reasonable doubt. Once that's done, then you get into the weighing process, which means the defense gets to present mitigating circumstances, which might convince you that death is not a reasonable penalty.

In Regard to your statement "I always get the feeling that there is a massive jigsaw piece (or more!) missing since no theory (pointing to guilt or innocence) that I have heard or thought of so far makes perfect sense. Do you mean that you don't see what her motive is?

I think between her new tatoo (while poor caylee was "missing", getting beer at Target and her dancing at Fusion pretty much somes up her "motive".

JA asks, is there any kind of circumstance or factor that you will always rule the death penalty automatically. She says no. JA speaks about the death of a two year old child. Is that a circumstance that could make your mind close to listening to mitigation? She says no.

Well the DT will not have any more back strikes so they have investigator out there digging up skeletons on PJ, and JB will try to drag those facts out to exclude a PJ for cause.

SA wants her in so that whole discussion was to ensure that DA couldn't strike based on her statements earlier re. the death penalty. This entire questioning was a strategic offensive move on their part.

OT- but have a look at Richard Hornsby's blog later. AS usual he has done his research and comes up with precedents that say the cans of carpet with THE smell should be allowed in!
I hope he emails that to JA.

She seems, IMO, very open minded to LWOP or DP, depending on the evidence and mitigating circumstances. AF up now.

KC shoots daggers at JA for the 2 year old child comment.......SOTS dives in front to protect him.

Why do you think the State struck the juror before the one that is on now? The one that was the ex beautician I think...

All the lawyers have been in court so long the Investigator thought they were missing .....hence this is the LAST place he decided to look and he found them ALL of them. :seeya:

Wow, ICA must have been smacked with reality. where is the smirky smiling face now? She totally acts like the jurors are on trial and she is their Judge. Buddys with her DT.

Hi Everyone,

I've been busy doing other forum business and haven't been able to catch up much on the Anthony case so forgive me if this has been brought up before . . .

Has anyone ever heard of the term "cart before the horse"?

Others have commented that she was very lukewarm about the DP and maybe too eager to be on the Jury.
