MOO he wants on the jury, so he says he is against the DP so the DT won't strike him, at the same time he states he can decide he can vote for DP if the law states...so the SA won't strike him.

I think he just means he would find it a difficult decision, but he WOULD consider it.

I'd be the same way, it would have to be an especially heinous crime.

HHJP: is giving the cart before the horse speech. he is telling the juror that all the talking about the dp is because they have to. each defendant is presumed innocent. do you have a problem with that?

HHJP: he is saying it must stay that way until the proponderance of evidence brought by the state outweighs that. the defendant does not have to prove anything. any problem?

HHJP: she has a right not to testify and you are not to hold that against her, do you understand or have a problem with that?

HHJP: if we were to get to that stage you will be given a list of agg and mit factors. agg must be proved beyond a reasonable doubt by the state. the mit need not be proven beyond a reasonable doubt but by a greater weight. 49/51. you understand?

However you are not required to recommend death. if you find the opposite....you must recommend LWOP rather than a sentince of death. any problem following that instruction?

I wasn't watching the screen when he said that. Is there any chance they had a shot of ICA's face at that time?

He could live with it. Okay, ICA, how's that sound?

Another juror concerned with innocent people being sentenced. I guess that's reasonable. He sounds less adamant than the woman who was extremely reluctant to convict because of that.

He says it is an "absolute decision." He is opposed to applicatoin of the DP wrongfully.
