AF schooling JB on what to say...JB saying that it is because juror cannot consider mercy, and she has a 2 yr old

JB - DT recognizes that she's a female. There are gender-neutral reasons. Has a daughter that has a 2-yr old. PJ said in regard to the DP she'd not consider mercy and does not consider age to be a mitigating factor.

Backstrike by the DT #1251 seat #22

State objects saying it's a gender based strike on a protected class.

JB saying females are no longer in a protected class, LDB saying it is and bring HHJP case law to prove it.

Who remembers - who was 1251?

JB stating cause on striking this one is because she has a daughter who has a child same age as Caylee and that she would not consider mercy

If the SA is going to object to any DT peremptory of a female then we are going to be here all day. Also does Batson apply to DT peremptorys?

This is going to be highly problematic: the DT will now start challenging every SA peremptory of a female.

I think HHJP was irritated with the last PJ - 3038. He brought out that she found out last week that she would not be paid, got a phone call last night from a court official and did not tell them of her problem. She was instructed not to go to work but went.

It sounds like English is not her 1st language. She wasted court time by not letting the court know last week that she would have a financial hardship. She probably would have been struck anyway for her language skills. She did sound like she was crying but it may have been her normal tone.

Good that she was excused for hardship.

JB adds unable to apply mercy and age to his objection. SA accuses the DT of using a pretext to object. Cites other jurors wouldn't apply mercy either.

So wait, they want 1251 gone because her daughter has a two year old (hello, jury of your peers) and because she she can't consider mercy? Didn't HHJP say mercy could not be used as a cause to strike, or am I wrong?

I wouldnt be surprised if HHJP lets them know court will be in session today until there are 12 jurors being sworn in.

<----huge fan of HHJP and I love his style!
