I don't have 4083 on my list. :(

4083 was from the new group just brought in, Patty. I don't think we had their numbers before now.

It is I who said that about the 50/50 chance and I completly agree with your rebuttal.
I have never been good at math and 50/50 was an easy thing to say. I should have put much more thought into my comment but the thinking portion of my brain has been fried over that past few days.

Jumping in on this one, I think they have as much, if not more, evidence as they did in the Scott Peterson case & we all know what happened there! So, I would give it a much higher chance.

HHJP: among mit factors that can be consider is age, existence of any other factors in the defendants life, character.

HHJP: the sentence must be based on the facts and the law. if after weighing mit and agg factors that mit do not outweigh agg or in the absense of mit, the agg are sufficent you MAY recommend that Death be imposed rather than LWOP. regardless of you findings in this respect you are not compelled to recommend a sentince of death. if on the other hand the mit outweight the agg or in the absense of mit factors that the agg alone are not sufficient you must recommend LWOP rather than death.

The process of weighing mit and agg factors is not a mechanical process. You and you alone are to decide what weight is to be given to a factor. Once you determine that it is up to you to weigh them. Little weight, great weight, up to you. Would you have trouble applying these instructions?

HHJP: if the facts of this case after the weighing process, if in your judgement a sentence of death is warrented could you recommend?

yes, if it was warrented.

HHJP: if it was LWOP could you recommend LWOP?

yes sir.

HHJP: treat both punishments equal. listening to the evidence and doing what you feel is proper under the law?

yes sir.

Question: At this point we've got 14 potential jurors. It appears that HHMP won't swear the jury in until tomorrow at 2:30pm.

If, by tomorrow afternoon there's a total of 16 or 17 potential jurors, will the FIRST 12 that were questioned be seated as the jury, and the remaining potential jurors (after strikes) will be the alternates?

In other words................is this done in chronological order?

What I'm wondering is if any of the potential jurors that go through voir dire today have an expectation of being on the jury of 12.

ack!!! this thread is moving so fast. Is there a specific number JP is looking to get through before the swearing in? I thought he was going to swear them when he had 12.
