I too noticed that and wondered WTH?

Well the press/spectators had been moved to the side of the courtroom gallery that the DT was sitting on to make room for the PJ's to be seated behind the prosecution.

The DT was clearly motioning to someone directly behind them - well - in front of them at that point as they had turned their chairs around. They were motioning to the press/spectator portion of the gallery - NOT to the PJ's which were then to their left.

I think if it happened in the big room long before instructions were given, it would be considered no more serious than news on the TV or papers etc.,. It also depends on how much that affected their opinion I think and they could be released for cause.
