One question JB might ask is why he didn't call LE when he noticed the odor...........especially since he claims to know exactly what it smells like.

EXACTLY!! So obvious. He saw nothing in the car. So what? He didn't see in the trunk!

Excellent and knowledgeable witness in Mr. Birch. What a strike of luck that he has years of experience with both towing and garbage... Extremely credible... Wonder what Mr. Baez will do to try and minimize his knowledge...

Talking about the A's coming for the car now

KC during SB's testimony of smell. simon.png

I typed up a wrong answer here and am deleting it!

He stated it was just a cursory examination at that point to determine if the car was in good enough condition to warrant their obtaining title to sell it on if no one claimed it. A walkaround with a a quick look under the car.Something he did to every car...

  • #1,446
Good, tow guy said car is very well sealed. So that would explain why others walking around may not have smelled it right away.

  • #1,447
If he knows the smell of decomp, why didn't he do anything? I believe that will be the DT's question to him.

Great question! If he does ask this, it will be because he read your post.

  • #1,448
Mr. and Mrs. Anthony came to pick up the car on July 15th.

  • #1,449
OOOOOH wow. Worked for Waste Management AND tow trunk co...knows the difference between trash and decomp!

What are the chances of that?

  • #1,450
I wish we could see the jury and the Anthony's while he testifies about the decompositional odor.

  • #1,451
Nice witness for the so looking forward to mr baez cross on this witness, got a feeling the jury will take alot of notice to him with him not having any agenda either way.

  • #1,452
Oh good we're getting to the opening the trunk/garbage bag part.

  • #1,453
Excellent witness. The car was well sealed and he didn't smell the odor until he cupped his hands against the window to block the sun.

  • #1,454
My gosh...who could have predicted that the tow yard guy who has smelled decomp before, actually worked in waste management...LOL on the DT! Hi is an excellent witness...well-spoken, intelligent, etc.

It's gonna be fun watching JB questioning him.

  • #1,455
Well, there goes the theory that this baby drowned and George was the last one seen with her body..

  • #1,456
He is very likable. Very personable and confident demeanor, which is good when it comes to the jury.

  • #1,457
WOOT WOOT !! My law clerk said if she were a teacher, she would show this video in class as to how to lay foundation and the perfect non-objectional way to question a very good witness.

  • #1,458
Mr. Birch's testimony is very interesting, very informative, very good witness. He sort of sounds Australian to me. ??
He sounds like Russell Crowe to me.

Did he just say Cindy came along with George to pick up the car???????

  • #1,459
Definitely, and he'll try and shoot down his knowledge of dead bodys - no formal education or training

Hope we didn't just give him his line of questioning . . .

Maybe we should hush-up........:waitasec:

  • #1,460
JB will try to shoot him down, saying he's not an expert on odors.

True, but he HAS smelled human decomp before, so he does know what that smells like
