Ok, morbid question alert.
Could Caylee's neck have been broken and she was too decomposed/bones too scattered/too whatever to be able to determine that?

Why can't she look at this guy?

  • #1,262
Talking about nostril opening on the skull. Tape wasn't covering the entire nasal area. He can't say for sure if it were covering the nose because THE NOSE WASN'T THERE ANYMORE. :(

  • #1,263
Go JA! on re-direct

  • #1,264
Great witness. He's very confident and not at all cocky. I think he is coming off very likable.

  • #1,265
Mason asking if witness can tell how Caylee died.

Didn't the defense already say they know how she died? Drowning

CM: how far is area A from the pavement of the road of Suburban drive?

25 to 30 feet

CM: (is not near mic)

I did not document the measurements.

CM: this map only shows different elevations?

yes. three D scanner was brought in, I did not do measurements.

CM: who provided the measure ments?

Ronald Murdock. not really measure ments. He and I looked through the data points for the flags and I came up with different locations for the bones. that map was created for me.

CM: so if I ask how far this was from the you cant tell me?

If I had a ruler I could

CM: do you know when the dispersement took place?

not sure I understand

CM: area A you say was primary site. right?

yes

CM: and all of those items were in bags right?

orginally. when deposited out at site.

CM: from site was gathered plastic bag and laundry bag

yes

CM: but other areas with bone fragments there were no bags?

not my job to analyize

CM: the majority of what was found was all area A?

I wouldn't say majority, I would say correct the majory of the skull was found in the bag.

CM: it was only after (?) that you found other bones, correct?

I wouldn't agree with that, when we began processing the scene other people were locating additional bones.

CM: the initial find was area A. you drew a map: go east go south

we had a crew and we were searching simulationously.

CM: and you brought them back and did your best to reassemble?

correct

CM: you don't have scientific evidence as to when area A was dispersed?

correct

CM: and the other areas too?

yes

CM: there is nothing in your work or in this case that tells you how this child died?

I would not answer that question.

CM: when you studied the remains and looked at duct tape?

I did not analyize the duct tape.

CM: nothing further

JA: what is a nasal appature?

the nose

JA: the opening where the nose would be

correct

JA: and the tape was not covering the entire nasal appature?

the mouth

JA: was on nose

based on what I saw no way to say for sure

JA: the nose wasn't there anymore?

correct

JA: a moment please.

Excellent JA.......refereinging the tape could have been covering the nose but it was missing.

EXCELLENT

On a child, a piece of duct tape is pretty big. Sadly, you probably wouldn't need two pieces of duct tape to cover the nostrils and mouth of an almost three-year-old. And they'd be very close together, I would think, even if you did.

I'm confused about something. Last night on HLN Mark NeJame said that Kronk was not compensated for finding the remains because he called 911 and not the hotline. Something about him personally giving Roy the money because he felt like he deserved it. Is this true?
RK could not accept the reward because he is a county/utility worker and was on the clock per what I have read. Some attorney who I can not recall paid him 5k.

Cheney Mason is cross examining the forensic anthropologist.

Trying to say that the anthropologist doesn't know when the bones were dispersed. Asked witness about COD and the witness said that wasn't his job. His job was to look for perimortem trauma.
When witness examinded the skull there was no duct tape on the nasal aperture. Now Ashton is asking what a nasal aperture is. The tape was covering the mouth area. The tape possibly covered the nose but hard to say since the nose wasn't there anymore...just the hole where it once was.

Tape covering mouth area. Possible tape also covered nose, but witness can not say for certain.

So, I have to conclude from this, definitely mouth. Maybe or maybe not nose. That means I have to toss out the idea that tape was over the nose, because it can't be proven.

Good info.

ETA: Although, I do have to add that if you tape a crying child's mouth shut, I can still see how mucus could fill the nose and prevent air. Taped mouth, blocked nose..

  • #1,272
JA reminds the jury the tape was not stuck to the nose, because the nose wasn't there.

I really dont understant this emotion that ICA is showing.

She looks more ANGRY then anything.. She constantly whipes at her CHEEKS as though thats where tears come from. I havent really seen more than a dozen actual TEARS through today and yesterday. She really just seems more Angry and annoyed that she has to sit through all this. Her brow is furrowed in anger. her mouth is tight and persed in anger. She is rocknig and kinda jostling her self in her chair.

She keeps whiping her cheeks tho. Not her EYES. Right now she looks like she is going to vomit. I would watch that... happily.

She is rocking with her eyes closed right now. Her fist is balled up and pressed to her mouth like she is trying very hard not to say anything.

This head shaking is baloney every time the SA says something.

  • #1,277
JA doing redirect. ICA hiding her face in her left shoulder again. Has same tired, wrinkled DRY piece of toilet paper still clutched in her left hand at her mouth.

#Faker

CM finishes... head back down.

  • #1,279
Now JA is going after "majority" as used by CM.

  • #1,280
good move Ashton, delineate exactly where bones were found to debunk(CM statement) that mostly all were in area A
