It seems like with these kinds of images, where they're looking at something so subtle, it might look different in black and white vs. color.

You are correct. I have never been involved in a case where the banding was an issue, but it is amazing what differences you can see in crime scene photos and the like in BW and color. Before it was said that they actually HAd seen the photos and knew of their existence I was totally agreeing with that they should have been given 48 hours. But having known that they were there, and didn't take them up on the offer to come in with an expert, I say proceed. It would be different if they didn't know they exist. Not to mention the whole issue that if there is a black and white photo, most likely there is a color one somewhere.

JA: This study was contemplated before the deposition in this case. He will acknowledge that obviously the deposition spurred him on to get started with it or words to that affect, but this was started because of an article raising the issue and indicating that additional research need to be done. So to say it was done for this case is absolutely not true, though the case did have some inspiration for it. That's all I wanted to say.
