CM - continued argument for judgement of acquittal

Poisoning by chloroform - he did not believe there was any evidence of this whatsoever. Dr. G employed Dr. Goldberg to try to prove this and they couldn't.

Duct tape - duct tape had not been wound around the child's head at all. There were 2 pieces found, one attached to some hair, another attached to it, and another 3rd piece found far away. This is an improper stacking of inferences. Only evidence of duct tape was GA putting it on a gas can and on a flyer at the command center.

Computer searches - only evidence was of self defense and at prior times.

Regarding case law handed to him this morning -

Jackson v State - ME did not say his opinion was based on the preponderance of the evidence as Dr. G did.

Abdul (sp) v State - 3 witnesses. Duct tape was used to kill the victim and he was doused in gas and lit.

Norton v State - gunshot wound to back of head not sufficient to premeditation. Goes to show the weaknesses in this case.

Concern of merger doctrine - Someone made a conclusion in that case. No evidence that ICA used duct tape, that she used chloroform or that she contributed to the demise of this child.

HHJBP - I have read most of these cases and has spent a great deal of time over the weekend researching and reading. Last night he reviewed the testimony that has been given in this case - so, recess until 11:15.

Not sure where to put this....I noticed that ICA starts to cry (or seem to cry) whenever someone starts talking about what a great mother she is. That seems to trigger the tears.....or fake tears.

I get the feeling (and many have said this) that she is somehow crying for herself here. I think her tears don't have much to do with Caylee. Maybe it is "I am a great mom"...whah whah. Or "I was saddled with parenthood...I'm a martyr" waaaaa. What do people think?

One thing that has never been addressed, directly, is that she "supposedly" knew Caylee was dead for 31 days...yet they neglect to consider that Casey Anthony allowed her daughter, Caylee to stay out in the elements through the summer, fall and part of winter...not to mention the hurricane season...and to decompose to the point that she was skeletonized. She not only DID NOT REPORT her Missing for 31 days...she let her ROT for SIX MONTHS!

I've wondered about this too. I wonder who's idea it was to let baby Caylee stay there long enoung so there would be no proof of how she died.

I'm sure Judge Perry is up on these cases, it won't take long to come back an say motion for acquittal DENIED !!:rocker:
