Thank you so much for posting this! I don't think the families are being well-served by Mr. Gray. Their priority is rightfully justice for their children. Everything Gray does should be aimed at facilitating that, not creating distractions for those who are trying to provide it. Did he even outline a single way in which the gag order was preventing him from serving their rights and needs? I think he just complained about being silenced. My apologies in advance if I missed something in his speech-a-fying. :)

After the arraignment, SG talked about wanting to see the evidence and then "I'm gonna bring it". And that "this is the family that's gonna make sure he doesn't get away with it." That gave me the feeling that SG either doesn't have a good understanding of the families' place in this process or he's in so much pain that he's not thinking clearly. Mr. Gray should be helping them with that, not stirring the pot. I thought it was interesting when Gray complained that HE could not speak. The gag order doesn't prevent him from doing his job as a lawyer for his clients. As far as I know, the only thing the gag order has stopped him from doing is applying to join the ranks of legal analysts for news shows. MOOooo

I did not know until watching today’s hearing that Shanon Gray is not only the attorney for the Goncalves family but is also the attorney for the Woodcocks, the biological grandparents of Lori Vallow Daybell’s youngest victim. (I don’t remember the little boy’s name.)

Idk, but Mr Gray seems to be bearing some kind of chip on his shoulder- just Moo. In the hearing this morning, it seemed to be about Gray and "my rights". Gray should be advising the Goncalves and helping them understand their place in the process. Represent them by all means, but within the confines of the process, help them and support them. I do not want to criticize the families or their representation really. This case must be about the victims and what best serves them and/or the state and citizens of Idaho. I would have to do what's best for the prosecutorial outcome, not my gut feeling, or my strong personal feelings. Ug. IMO.

The judge says he is not going to issue a decision today. He will issue a written decision. The gag order remains in place for now. "I heard some very interesting arguments today... I will try to get a decision out as soon as possible."

I'm surprised BK was allowed to wear civilian clothes to this hearing? Is this the norm in ID?

Okay, another reporter's perspective from inside the courtroom ;):

Just touched down in Moscow, Idaho. I'll be in the courtroom tomorrow following the two proceedings re: the current gag order in place for the Kohberger trial. Follow along - I'll live tweet as I can while bouncing to liveshots for
@NewsNation to provide updates thru the day.

Judge: "One of the issues is that this is potentially a death penalty case...The families of the victims would certainly be witnesses..." "I have a job of protecting and preserving the 1st amendment and also the 6th amendment. And there is some balancing there. That's why

Gray says he is in disbelief that the prosecutors office is not in agreement about his motion. Mr. Gray: "I have not seen a poorer line of communication in my 22 years of practicing between the prosecutors office and the Goncalves family.”

The first of two hearings is scheduled to begin in a few minutes. Today it's all about the gag order that severely restricts the ability for anyone in this case (attorneys, law enforcement, victim families) to discuss it openly.


Now Gray saying that this gag order has prevented his clients from having any access to the facts of the case. Judge seems surprised by this statement. Says he is learning new information and that everyone will have a chance to speak.

Mr. Gray has made his case. The State will now have a chance to share their beliefs on the motion. Latah County Prosocutor Bill Thompson: "We have a duty of candor to the court. Mr. Gray has made representations to the court that are at best misleading... I do not want the… Show more

Kohberger's legal team now speaking. Attorney is going through previous case law. Kohberger is looking straight ahead. He could be listening intently, but he appears to be focusing on a single point in front of him.

"At minimum, it is insincere that he is being bound by the order when it is clearly not being abided by." -- attorney making the point that Mr. Gray and the Goncalves family have made many media appearances since January.

Attorney making the point that the rights to a fair trial for Kohberger will be compromised by pre-trial publicity. "The order is an appropriate measure of the court to uphold its duty... to preserve the right to a fair and impartial trial.”

Kohberger attorney asks the court to uphold the non-dissemination order or tailor it with specificity. 2nd Kohberger attorney now speaking. It is defense's position that anyone involved in this case is involved in the litigation. That goes for Goncalves family and attorney.

Kohberger Attorney on pre-trial publicity: "It seems that no matter what anybody says or does, in some way, it will be twisted against my client."

Mr. Gray now gets a chance to make counterpoints now that we've heard from pros. & defense. Gray says that he is not participating in front of the courts and is not a party to the case, therefore the non-dissemination order should not apply to him.

Mr. Gray: "This idea that [the Goncalves family is] going to be witnesses in this case is just an attempt by the prosecution to shut them up as well as shut me up.”

Media coalition says Kohberger's team is trying to introduce evidence in regards to the gag order and the media hasn't had time to go thru it

We are back for the second hearing -- media wants to intervene for the purpose of the gag order, judge grants it.

This proceeding revolves around the gag order and the restrictions it places on the news outlets who want to cover the case. A coalition of media outlets believe the gag order restricts first amendment rights.

I totally agree. But I don't know if Gray knows the proper place of families in it all. If he's been practicing as long as he claims and making a decent living, he can't be as clueless as he seems at times per reporters' tweets, I guess. (It's not just grandstanding although I think he's doing that too.)

For example, Emma Epperly's account says Gray said the prosecution "should be representing the families." Well, no, that's not really true. And Gray shouldn't tell families that it is. The DA represents "the state."

For example, after getting "caught" re: his claim the state hadn't talked to the Goncalves when he was actually blocking that, Jordan Smith's account says Gray then said in court "Nothing precluded the prosecution from contacting my clients well before I started representing them.” What??? I'm not sure exactly when Gray showed up but he was definitely on the job representing the Goncalves in mid-Dec. Why would the DA talk to the family then? Nobody had even been arrested. Saying that made no sense and didn't get Gray off the hook. And per press reports, LE had talked to them. More than once.
