This is all for show, a lame attempt to speak to the public and future jury. There is no way the defense will get all of the records, if they really wanted records they would have jumped at the chance they were offered, after JS's original ruling. How will Jose explain to Judge Strickland his reason for not picking up the 32 records he fought to get access to, when he went to court on this the last time ?

Prior to Casey indigent declaration, defense had to pay for obtaining records. Now , they might be picking up more, since state of FL will pick up the cost .
Pls correct me if I am wrong but would that stuff not be free/reembursed to the defense now?

For all the jumping up and down the defense has done demanding more information from TES, they better be careful what they wish for.
It is very interesting, since the time the defense filed their latest motion on this, what we learned from the various T E S searchers in their statements in the recent document dump, all of them say the area in question was under water! God knows their attempt to hold J. Jordan up as their example went over like a lead balloon. This isn't going the way they hoped.

Moreover, Mr. Miller's statements were released in the document dump. In them he details some very bad facts for the defense. It is painfully obvious, that it certainly appeared to him that the entire family knew right away Caylee was dead. George in front of Tim asked Casey to help them by marking the spot on the map of where they should look for the baby's body.

This blows the we need to hunt down Zanny the Nanny defense , completely. It makes Dominic's search of the woods even more suspicious. It means the family took advantage of the FBI and LE and TES resources, and violated the trust of the public, opened a Caylee is missing request for donations all the while knowing the truth. This is the biggest bombshell, imo.

These latest revelations coming from the TES camp could not be more damaging for Casey, or mom and pop for that matter, that all that they did was a lie from jump. It makes pointing the finger at Jesse, Amy and Kronk even more hard to swallow. Any sympathy folks may have been holding on to will be fully washed away, now that Mr. Miller has shared that the truth about Casey never mentioning Caylee's name, instead she was smiling and acting as though she was going to a cheer leading party. He is going to be a pivotal witness. The defense cannot combat his testimony with calling it junk science. He is going to appeal to the jury at their very base common sense. Out of all the cast of characters, imo the jury is going to believe all that he says and trust his judgment. These statements released in the document dump are very tough for the defense to overcome. If I were them, I would regroup and come to this hearing with a new tone. If the public perceives them as being hateful to even Mr. Miller, imo, they will have no, zero credibility ever, on any subject.

The defense really is picking a fight with the wrong crew here. It has backfired in ways that would be tough to measure. They better pick a more likely villan to try to insinuate wrongdoing against than the beloved Tim Miller, an American hero.

I think they have to submit paper work for reimbursement of costs, but the approval for that comes from the Judge. I hope that Judge Strickland will grill them on why the records were not picked up after the original ruling, while Casey was not depending on the state for money. I feel for Judge Strickland.

Everything you say imo is so true! But what I hate about it is that it leaves no doubt that Tim will be the next giant bull's eye. He is my hero. But he is a real man, of flesh and blood, and now going through his own personal challenges. I shudder to think that he has to be the next sacrifice though the jowls of the Anthony sharks. They have no moral boundaries and can find the underbelly that every human carries with them. It infuriates me that Tim will probably have to face this, too.

I feel both wounded and infuriated that Tim Miller has to be exposed to this. And only because he was guilty of trying to find a sweet, innocent lost babe.

I was joking with a friend recently that I like to think I am well liked and respected, especially at work, but if any investigators were to drag up my teenage years, that my mother still hasn't fully recovered from.....I'd be ruined. If the defense experts try Kronking* Mr. Miller, or any of the good, good people that came out to search for the baby's body so she could at least have a funeral, I think the public backlash will make the angry protesters look like a tea party by comparison. He and FOUR THOUSAND VOLUNTEERS showed up for that little girl, which is more than I can say for her own family!!!

Fabulous writing there, World. You bring up a sentiment I'd like to back up - Tim Miller is made of heart and soul, and maybe some of those puppy dog tails they talk about in song and story. Everything about him; his face, his eyes, how he sits, the imagery of "throwing up my hands" in his testimony - these things are the first and only pieces of true compassion and humanity in all of this mess (save Allen, et. al, but that's on a different level). The sense of deep sadness I feel whenever he speaks about Caylee - as he IS the only one speaking about Caylee - is immeasurable and very, very real.

How many times now has this very subject been brought before the court? And how many times will JS allow before he breaks instead of bending? I would guess (and hope) they are on his last nerve! 'Cuz they're sure on my last one. :furious:

Thanks! I was going to ask the very same thing. I really feel like this has been addressed three times now..(Will someone please list the amount of times?) and Baez and co. just don't get it. This isn't even due to the obvious inexperience the defense has of FL law. It's just sheer ignorance.

All very true, ITA! What I *think* is going on is the following. I personally think *someone* or several people pulled blank TES forms from the website and filled them out as IF they searched. All the defense IMO is trying to do is make TES look bad by saying they lost records or didn't turn certain forms over. I have a gut feeling about this. All they are attempting to do, is make TES/Tim look dishonest and discredit them. They have obviously dug up people who are are making claims they searched this area. I certainly hope they aren't just counting on Mrs. Baker Act aka JW.

Yes, Gnatcatcher; you said it well. Remember when SP, Caylee's great-grandmother, said she thought maybe Casey hated Cindy more than she loved Caylee? Well, Tim is the diametric opposite to that. He loved Caylee enough to put himself on the line for her in spite of how much he was resented by Cindy! I'm praying he's already sacrificed enough for the love of Caylee; that he won't be further drug through the coals!!

OMG! If someone did that, I want them jailed!!!

I've been thinking about what exactly it is that TES does.
Can you imagine, his daughter was murdered and every day of his life, every single day of his life, he gets up and helps families search for their missing kids, in all conditions, against all odds, all across the country..... for very little thanks and no pay? To me he is Jimmy Stuart, the valiant knight, Santa Claus, and the hero cowboy in the white hat all rolled in to one. I don't even know the last truly good, good thing I did, let alone make a life of service. You know what, I betcha Tim can handle anything the Anthonys and the defense throw at him. I should not worry about him. I can count on my hand the people that have inspired me. He has, not because he is perfect, but because for these kids he keeps showing up, day after day, year after year, over a thousand searches !!! He and others took the horrible treatment they received from the Anthonys and turned their time in Florida into something wonderful. There is now a T E S branch there to help families going forward. Impressive, huh?

If someone did what you fear, falsified TES documents...without question they need to be held criminally responsible.

We need to remember that Tim has MN to defend him and his good word.
I'd love to see MN rip Jose a new one for not grabbing the records when he had a chance. Of course the battle now will probably be between Mason and Nejame....I'd like to buy tickets for that one!

MN is 100 times the lawyer that JB and AL are put together. He won't pull any punches. I think it might be more personal with MN than just being a retained attorney. He has been involved with this case "Caylee" in one way or the other since the beginning.

Good theory. I think that is the "interference with my investigation" (paraphrased) that Cpl. Edwards spoke of in his interviews with Joseph J. His concern was false documents being produced from the defense. Not surprised.

..i wonder just how much will come out at mondays hearing.
..from my understanding of the transcripts:

..joej IS a volunteer with TES, searches the suburban area with 5-6 people sept.1/08-----water is knee deep.hands in his field report.

..lindaB calls him up---april/09 ,( tells him she is Kentucky LE---now doing some work for baez)-----remember me ? we searched suburban together back in sept /08? he says he has no clue who she is---and they never searched together.she Insists! he asks her not to call again.

..mort ( PI for AL) shows up WITH a copy of a TES field form--tells joej that he got his # from lindaB--and to look at the form, to refresh his memory---( his name is on it--written in a female's handwriting)LB's name is on it- he maintains he did not search with, doesn't know lauraB.

..jj also points out that TES forms are to be turned in each day-----and NOT brought home.( so mort, lauraB should not even have that form.)

..lindaB also states that although she was a TES member---she and others were in that area "on their own" , and were not assigned that area.

..TES claims that lauraB doesn't show up in their records.

..in this latest motion, lauraB's stmt. has her living in new jersey. ( what happened to the Kentucky LE job ?)

..jj states, in his stmt-----he dug around, and he believes she's friends with the A's...in orlando--(ok,orlando-newjersey-kentucky....)

This argument is from their side!!!!

After watching this hearing what strikes me as interesting is that neither Jose, Andrea or Todd understand the basic problem....they keep offering to copy the records,they cannot do so. Mr. Nejame argued, AND THE JUDGE DID CONCUR, that they could REVIEW WITHOUT COPYING the documents, then if and ONLY if they found some other searches they felt were relevant...all parties would convene with the judge in camera ( in private) and THE JUDGE WOULD DECIDE IF THEY WERE RELEVANT. Reviewing documents in a lawyers office is not uncommon. Surely Todd, Jose and Andrea understand the concept and the judge's ruling. What makes them think if they ask enough times he will change the ruling? Remember when you were a kid and your mom told you no means no and if you ask me again I will give you something to cry about? With the recent document dump, and all the revelations from the TES workers, I do think now the defense indeed has just what mama warns us about.

I think it is very, VERY compelling that Brad Conway, the attorney for the child's grandparents was permitted to review all of the documents, for days, and HE found even less than the 32 searchers to have been in the relevant area!!
Clearly, he would have made a determined effort to find anything that could help Casey and nothing was found. That speaks volumes to me.

He has elegant manners , and still the effect of his learned arguments is a thorough mopping of the floor with the defense. I agree with all of you on that, one hundred percent!! He works for T E S pro bono and he too is a good guy. We have to search high and we have to search low to find the good guys in this case. So when we do, I celebrate them.:woohoo:

After the defense has put on their case..the searchers that may claim they searched and the remains were not there..."The prosecution is going to come back with their rebuttal and just destroy them....demonstrate that their witnesses with showing that they are misleading, were dishonest or just plain wrong about what they remember, " Mr. Hornsby said.

On Monday (10am), Casey Anthony will ask a judge to give her more information about the 4,000 volunteers from Texas Equusearch, the group that helped look for Caylee.

Last year, a judge ordered the company turn over personal contact information for only 32 of the volunteers since they had been the only ones in the Suburban Drive area where Caylee Anthony's body was found.

Organizers with Texas Equusearch said none of their volunteers were ever in the exact spot were Caylee Anthony's body was found by the meter reader, and added that Anthony's attorneys could visit their lawyer's office at any time to inspect the records.

Yet, as of a few weeks ago, the defense had never made a trip across town to look at the records they are now seeking.

I am hoping Mr. Cheney will come to court and ask for the fees to pay Mr. Nejame's office ( the fee to have someone sit with the defense members who review the records in Mr. Nejame's office ) , make the appointment and show the court that it is a new day at the defense table, he is ready and willing to get to work. Wouldn't that be refreshing?
