Quite possibly Nejame and TES may just file a new motion or complaint on the matter. Then again would this order by Judge S. be considered and unresolved issue? I would be interested to hear what our leagle eagles think of this.

True. JS issued an Order, so it is not 'unresolved'. The defense just hasn't complied. NeJame could file a motion for sanctions (I think he has already filed a motion to compel...right?). Or would the defense need to file a motion for reconsideration? Heck, if I know. :waitasec:

This is exactly why I am anxious to see how Judge Perry handles this dispute. It will give us an idea of how patient he will be and set the tone, iykwim.

I will go over to the atty. thread and ask them to come review this thread. :)

All of the motions, sanctions, motions............oy makes my head spin I tell you. It gets me so confused.......:crosseyed:

So I suppose since Baez wouldn't be specific as MN wasn't in court we wait for the motion to find out what the problem is and what he wants modified now.....

Okay Sleutherontheside, what do you think REALLY happened at MN's office with JB and CM. If JB stated in court that he did not want to go into it because MN was not there to defend himself, what could have possibly happened?

If JB and CM were just looking for location information the order in which they were filed would really not be a reason for them to leave if they planned on going through the whole 4,000 files. If MN was out of the office that would have been poor planning on JB's part and MN certainly would not have to defend himself. We know from reporters that they were going through boxes in a conference room. So what was so upsetting they had to leave????

kinda makes one ponder if they perhaps tried to do something they weren't supposed to do as in make a copy or photo (w/phone)---IDK--the defense never seems to object all to much for any media attention unless of course it doesn't "benefit" them or their cause.....jmo:waitasec::innocent:

I am so looking forward to TWO new motions to be filed, one from Baez and Mason and one from NeJame.

I do hope they are in time to be heard with the rest of the non-dp motions the second week in May.

Complete speculation on my part...........per the Judge's order they are not permitted to make notes, copy, or otherwise reproduce any information in the documents......only flag areas they wish to be copied. Perhaps they whipped out a pen and paper...or wanted to text notes via cell phone or use a camera phone????

Perhaps they felt "stifled" by there being a third party in the room to supervise (as per the order) and said they couldn't discuss freely what fish were likely to be biting at that moment or in the future.

Or as TWA has said.....maybe the press got their money shot and there was nothing else to do there.

It appears they were looking through some boxes of documents. The reason for them leaving abruptly is not known. So we are left to wonder what would cause them to leave if they had notified MN and were prepared to go through the documents with a paid individual who was schedule to watch them. Would seem rude on their part if MN made arrangements for a paid monitor to sit with them and then they just leave without going through the documents they claim they needed so desperately. Any guesses as to whether MN will be in rare form on Friday?????? Should we "suit up"????? jmo


ETA: From what I remember the original files were located in a storage area about 5 miles from MN's office. So these would be copies if what is reported is true.


Just seems to be how they handle things. They stomp they're feet and whine about something just to get their way, but don't follow through.

1. They complained to every media source that would listen about not getting in to the crime scene and how they were being treated unfairly (even though it was the law). When LE released it, they said "nevermind".

2. There was some docs they cried about not getting, said they were being held from them - when JS told them all they had to do was go to the court house and pick them up, they didn't.

3. There were some forensics docs they wanted and were again saying they were being held from them and were again told to request through the FBI, but never did.

4. When they went to inspect the car, they left for lunch and never came back. NEVER.

5. They were given prior opportunities to see the TES docs, and never did.


It's obvious JB's plan is to scream and shout and hope no one calls his bluff.

He's too busy out in his garden planting his little seeds to be bothered with the "real" stuff

Hmmm... Maybe, just maybe.. they didn't set an appointment to view the files. Which would most likely mean the files would really be unavailable to them at that moment. So they could go back to the Judge and claim that they tried, that they did what the court asked, and still could not see the files.

An appointment would be needed. It would take time to bring the files from the storage location, ensure a room would be available for use, and office personal available to baby set the proceedings.

And just maybe, JB realized that the Judge would't rule anything until he heard the other sid, so he might as well act like he was the one who was being nice.. And that this Judge would spell out for him that he should have set an appointment to ensure the files would be available...

The defense, imo, is just posturing here. They can't possibly put on a reasonable defense without access to everything everywhere at anytime and photo copies of everything. They didn't show because they are on a fishing expedition. Unlike what the defense claimed in open court, they have no proof that anyone other than their client disposed of the victim, Caylee. But they can sure cause a stink about it...like, "we weren't given access to everyone in the United States of America's emails...so like how are we supposed to defend our client...how are we supposed to put on an adequate defense?"

To which I simply say, ask your damn client what happened...

I hope that Judge Perry won't put up with any whinning from Baez. How I can't stand that man...can't even stand to look at him. He does look like Pee Wee Herman but with a wider face.

The judge will not.
What it appears the defense is doing is trying to have everything Judge Strickland ruled against them on, heard again and hoping for a new result. They ought to reconsider that, because he may come down harder on them and restrict them even more than they were. Wont that be too funny?
This was their would be last hope and when the judge didn't give them the ruling they wanted, they thought they would try their luck with a new judge. The joke is on them.

I am curious to see what the defense accusation against MN is going to claim, if it is so terrible that Mr Baez cannot even bring it up without MN there to 'defend' himself.:waitasec:

Will a new judge really go over the head of the previous judge's decisions? That just doesn't sound right to me. In fact it is down right sneaky of the defense to run Judge Strickland's decisions past Judge Perry in the hopes that Perry will change the decision. I know I will lose respect for Judge Perry if he reverses any of Judge S. decisions. I hope Baez is the one that faces Judge Perry over this decision cause I want Judge Perry to rip Baez a new one in front of everyone.

I did read something somewhere that suggested the files may have been in NeJames legal storage area which may or may not have been offsite, and because the Defense team came without notice, they would have had to wait while they were retrieved and chose not to do that.

How would it look to the media after they'd alerted them to their visit? Just sitting around instead of being able to get down to business.....just saying...


Baez and Co choose to make everything difficult and have done this from the beginning of this case. They better watch their P's and Q's from now on or Judge Perry might make things even more difficult for them when he puts them in their places.

If they had made an appt to view the records the attorney would have had them ready for the attorneys and they could have called every media outlet in Florida to come watch them read the files..can't think of anything more interesting then to watch Baez read files with his dictionary handy so he can look up every other word to see what it means. I'm hoping that they learn what following the rules mean now that...at their request...Judge Perry has taken over :woohoo:

However in this case, the Judge ruled and the defense continues to put in motions on the subject. So, sometimes the decision gets changed or looked at again. I may see bits and pieces on you tube, but my beliefs come from the whole truth, not just bits and pieces from you tube.

JS was nice about it. This judge will tell them like it is, as in: "Did you not hear me the first time?" Pretty bad when CM has to cough to keep JB on track in front of judge. LOL jmo

Long thread to go through, so forgive me if I'm repeating anything - I'm reading about this and NaJame puts up a good argument - all the defense has to do is walk down the street from the courthouse and look through the documents - so the defense goes in without calling first and the media is there - and the defense thinks that NaJames office called the media - so now the defense is going to refile the same motion

So, if the defense goes in without an appointment, NaJame isn't there, the media is - HOW would NaJames office know that the defense was going to show up UNLESS the media followed the defense there?? The media is staked out at Baez/Mason's offices and calls ahead to their compadres and so media shows up ahead of the defense

and then the defense leaves in a huff

Now, I'm wondering what does the defense expect??? Out of respect they call NaJames office, make an appointment and go in and do what they wanted to do - to me the defense has showed little to no respect to anyone connected to this case - UNLESS that person says what they want them to say

I find it interesting - not only is this a problem (which I am looking forward to hearing NaJame argue in front of the new judge) BUT the witnesses for the defense that they think will prove that someone else did this don't want to do depos for the state - guess they are changing their minds
