I just dont understand why 4,000 volunteers have to have thier privacy invaded or even 32 volunteers for 1 person who is obviously guilty. The defence does not even have a valid reason for needing this information. This just makes me mad

In MN's filing today, he asks the Judge to not allow ANY of the TES searcher's names to go PUBLIC ... so, if the Judge grants that request, the Judge has the authority to ORDER the Defense not to release any of the names that they see on the TES documents. That way, if ANY mention of TES searchers comes out publicly (through Defense team members or their mouthpieces Cindy or George) .... it will be obvious that the Defense disobeyed the Judge's Order. IMO

Now tell me faefrost, have JB and CM underestimated MN's abilities as an attorney who seems to know his stuff or do they just enjoy the public humiliation. They should have stopped while they were ahead. jmo

I don't think CM ever actually saw or read these motions until they had already been leaked to the press... I mean filed with the court. CM may be grossly overrated, but I don't think he is quite that bad. His big sin in this is not knowing to not shoot his mouth off in public or in front of a camera when he really hasn't done sufficient due diligence to research all of the details and nuances of the high profile case he has inserted himself into. But I'm still betting he can probably craft a better motion that what we have been seeing, even if it would be heavily interspersed with countrified gibberish.

This last one just screams of JB's approach to the law, which mainly seems to be alot of whining like a 5 year old on a playground, and little actual reference to anything remotely resembling laws, prior case law, ethics, rules of conduct, or grammar.

I think MN is asking for the extreme remedy ... knowing the Judge will compromise somewhere in the middle while avoiding appeal issues.

I really like that MN added a request to the Judge to not allow the release to the PUBLIC of ANY of the TES searcher names. That is what JB wants to do (along with doing background checks on every one of them). JB wants to find something resembling "dirt" on any of them and then shout it from the rooftops! JB wants to "Kronk" them!

So, even if Judge P. does allow the Defense to go ahead and review all 4,000 docs AGAIN, and tab some, and even if he releases any more than the 32 docs already given to the Defense, at least JB cannot do any sneaky stuff with the searcher's info PUBLICLY. If he tries to, he will get slammed by the Judge.

I think MN will get what he really wants. The judge will probably bar the release of names or any information on any TES searchers that will not be specifically and clearly used at trial, and the defense will have to clearly explain and show cause for each and every individual record above and beyond the 32 they have already received. Which will maintain TES provacy about as much as can be expected, and will make JB have to fight tooth and nail, and provide a convincing and valid arguement for each and every name he wishes to examine.

I thought the 3 searchers were Nov 15th ... Nov 16th ... and then some day after that???
Thanks, ThinkTank. It must have been pure speculation...but...do we have a way of knowing that what DC says is true? Any emails match? I hope in the depo (done?) they ask him specifically when was the first time he went out in the woods. Even John Morgan was very curious when he interviewed Hoover. Hope they ask about that map as well.

After reading NeJame's response, I wonder how happy C&G are with Brad right now? NeJame says he talked to him as late as 'yesterday' and Conway agreed that there was NO pressure by NeJame to grant the waiver.

That is NOT what Cindy says in her rants. He did not appear with them on either of the interviews they did on Friday either. I wonder if Brad has finally seen the light and is getting ready to jump ship?

I think BC is acting like the professional he really is. There is no controlling CA and I think BC has stayed close to the A's because he knows the truth and wanted to be there when reality checked in. He has a looooooong wait and he may be beginning to realize it. Besides why run up a bill when you don't have to. If he's with the A's on their media tour he is not doing work for his other clients who pay......jmo

I think it must have been very difficult for Mark NeJame to reply to JB in a dignified manner. The accusations hurled at him and the insinuations were so ridiculous but he managed to get his points across and not look like a spoiled child doing it.
I still think Judge Perry will allow the TES docs to be scrutinized just to err on the side of caution.
Although, this trial could be legally flawless and I do believe there will still be attempts at appeals.

Appeals are like lawsuits, anyone can file them. But they can also quickly be denied as without merit.

OMG, if the Judge does that, he's just submarined Bozo's entire strategy for wanting the files! That would be fabulous imo

IMO, I think MN knows that it will happen. He just briefly stooped to their low level in allowing the motion to be his "mouthpiece for the world". We all know how low the defense has played this, and I believe MN just wanted it out in public for all to see.

Yes, it's the first time that "bad faith" has come front and centre. Somebody finally said it. And perhaps this might nip in the bud any further "bad faith" shenanigans in relation to TES by the defence.

Macushla, you hit that nail right on the head....what's in store next??? See, how CA turns on a dime. BC was the only attorney willing to work with them and that included working for ICA. Unfortunately, CA has no more use for him since she truly back stabbed his intentions and went with the inept attorney in ousting BC...shame on Cindy...she is truly a piece of work! I think all that she stated last weekend on The Today Show, is lining up the nails for her daughters coffin. She truly shot herself in both feet...JMHO

Seriously, I think BC has been looking for a graceful way to bow out and JB just gave him one. I wonder if G&C will try to find themselves another lawyer. I can't understand why they felt they needed one in the first place though. It's obvious they won't listen to anyone's advice, so why bother?

You are right they do not listen to their lawyers, clearly. More than that, IMO, mom and pop have done things behind Brad's back. I wish Patti's videos were not gone. In one of the hearings Baez is arguing c o i and Brad starts shaking his head NO, then Andrea chimes in and says "We just got a e mail from them ( mom and pop) on this LAST NIGHT". Then Brad continues as if that is the most ridiculous thing he ever heard. I would not be surprised at all if indeed the defense has in their file such a homemade Anthony e mail insisting they never waived anything regarding Mark. Does anyone have recall and have this tape? Clearly the letter that Cindy wrote was not run through her lawyer, since it is opposite of what Brad has said on their behalf in court and in public. IMO, this has been a long time coming, and Bae'z motion just put the exclamation mark on it. Whatever Johnny come lately e mail or letter the Anthonys write, the fact remains that Mark Nejame has a signed waiver in his file, contemporaneous with him signing on with TES. Anything new is just icing on top of the perjury, someone wrote once about this case. It fits!

Mr. Miller had it spot on when he said anyone who gets involved with the Anthonys get body slammed. ( paraphrasing ). The perpetual question is....who is next?
