As I recall, Judge Perry maintained Judge Strickland's original ruling with these exceptions:

Perry's 1st order: Deadline of August 25, defense could take notes, special magistrate
Perry's 2nd order: Location of the examination of the documents, added State's Attorneys to the review process prior to bringing documents to the judge.

He never changed the deadline. Whatever his last order was, the defense had the right to view the documents from the time of his first order. The defense would have had 8 work days to view the documents in a neutral place after the meeting in the judge's chambers.

My bet is that the defense didn't meet the deadline and the judge had made himself perfectly clear in his meeting with all the attorneys.

I keep telling myself that patience is a virtue... it's not working!

The last time this motion was filed, it was by Mark Nejame. I am wondering if he is renewing his attempts to stop the defense again.

TES was the party to come with the records of the searchers. A motion to quash would mean that TES would not be required to produce the records.

A subpoena duces tecum is a subpoena for documents.

We need to see the motion to be sure that it is referring to the same subpeona duces tecum as the one the defense filed to view the TES docs. If it is, then it had to have been filed by MN. Maybe just to preserve the record and in order to appeal any decision to disclose any docs other than those that refer the the original 32 searchers. ??

Hard to tell without seeing the motion.

After the status hearing, WESH 2 attended what was supposed to be a routine scheduling hearing between the defense, prosecution and Texas Equusearch attorney Mark NeJame.

Newly appointed Magistrate James Glatt set Oct. 4 and 5 for dates when the defense will get to look at Equusearch records.

JMHO, but I have always believed that these were not all that important to JB, not matter what he says. I think it was just his "convenient excuse" to delay, delay, delay.

I think the Oct. 4 and 5 are probably because JB is soooooo bogged down in depos that should have been down a year+ ago as he is up against the judge's deadline.

My take is that the bulk of the "work" JB has done thus far, pertains to mitigation for the penalty phase and creating appeals issues.

Depositions - JB is a busy busy guy in September - masses of depositions to get through and we know he's a one task at a time kind of guy - no multi-tasking here. No time to do color coded charts, write nonsense motions and do tv spots if you do two things at once.

You know I do hope he has to work evenings and weekends...shouldn't this have been done months and months ago????? Seems like he only began when the state started paying (and still doesn't do much at that---except of course WHINE!!!:furious:)

Still gets me mad every court hearing he moans about how much discovery he has to look at---Most of it should have been done---I know the people here get it done quickly----he has help in his office...the things he chooses to whine about!

Good point! Many of us here WORK 8 hours a day, 5 days a week, don't have assistants or housekeepers, and STILL are able to keep up on the discovery without problem..LOL. His whining is so obnoxious. The dog ate my pencil so I can't get my homework done.

Thanks nums! I was digging for this thread to post this update. By the time I was on pg. 5, I knew you had to have bumped it. :)


Happy to know they have to stick to a script approved by Judge Perry.

So much for the presser. All I got from it is Baez now has help - a couple of people to read the 8000 pages of just released documents - we know he's much too busy for that kind of nonsense.

I love this stipulation re the TES Searchers! So Baez, your world hasn't changed at all. Come out of your office and have someone read this joint stipulation to you. ICA is still guilty and the walls of your world are still closing in on you.
