Well this is the thing, right? Anyone can open a business, no problem, much like Creative Designs. But how was he able to be pass a criminal background check or a vulnerable sector check likely necessary to become a Mall Santa? Also, how does someone become another person's surety (not naming anyone) with such a violent criminal history? How is someone able to travel with such violent convictions on their record, when other people get denied for drug possession charges? These are the things I ponder.

It was mentioned earlier on this thread that "it's unfortunate that he was pardoned". So I'm just trying to follow up with that.

I remember seeing that comment but there was no link or proof of the pardon. I think it was being questioned, in the article about surety but still legal. IMO

Pardons in Canada have been renamed "record suspensions". The words are essentially interchangeable and mean the same thing. After your sentence is complete, anyone can apply for a record suspension, but there are specific provisions. You have to complete a period of good conduct before even applying:

Summary Offenses: 5 years
Indictable Offenses: 10 years

This literally mean you can not in any way, shape or form, have involvement with LE for either 5 or 10 years. Even if they see that you have been brought in for questioning, that can put your "good conduct" at risk.

Record suspensions do not mean that the crime didn't occur, that you're no longer guilty or that the accused was wrongly convicted, it means that after a period of good conduct, the convictions are removed from the database and kept separate from your active record.

I looked up BM's convictions, and they are hybrid offenses. This means that they can be tried as a summary or indictable offense depending on what the crown wants to do. Considering that BM received only a conditional sentence with no incarceration, I tend to think he may have had his charges tried as summary offenses.

So that mean a 5 year good conduct time period was implemented. For at least 5 years he had zero interactions with LE. His sentencing, including probation, would have ended in 2008. A 5 year good conduct time period would bring him to 2013 before being eligible. It can take up to a year for an application to be processed.

From 2008 and 2013, during his good conduct period, a few nefarious things happened, but that's neither here nor there.

In any sense, let's say in 2014 his record suspension was granted. That would have given him a good 4 years to travel freely and pose as Santa Claus with children.

I’m going to come right out and say it: IMO, it took the disappearance of a white man (with friends and family who wouldn’t shut up and kept pushing) to get LE moving on this :(.

The local community has been TRYING for YEARS to get TPS to react.

I’ve previously given TPS a lot of benefit of the doubt, not doing so any longer.

Face it - if you're white, middle-class, straight, have relatives and/or friends who will raise the alarm, TPS and other forces across the country will care. If you're anything else - indigenous or poor or black or mentally ill or engaged in "risky" behaviour (which could be anything from being a sex worker to substance abus ) - good luck. There's a reason for the MMIWG.

Yes. I feel like this is the way it is in US too. Makes me think of the girl in her twenties on the spectrum or who had some type of mental defect who went missing with her brother (cousin?) who was under three years old. They were black and their thread here is bare and there seems to have been very little done to find these two. To me they would be considered AT RISK because of the nature of their disappearance and the age/mental state of both. Yet (and no offense to her, her disappearance is very sad too and deserves looking into and her family deserves closure) Maura Murray is still being debated and discussed despite the fact she ran away from a crash scene, refused help from multiple people, and was intoxicated. Predators prey on the weak and while I agree young pretty white women are very likely to be abducted or sexually assaulted or murdered, people from minority groups, runaway teens, LGBT, and sex workers are just as likely to have something like this happen and they are just as important. I feel sad and angry at the possibility that these latest two might have been prevented if TPS had done their jobs to the best of their ability. #endrant

I understand why people might feel angry, but I'll wait to find out what lead police to McArthur before I make judgements about whether he could have been caught earlier. Solving crimes isn't a matter of caring and trying hard, it depends on mistakes the perp made, or clues left by the victim. The British have spent £11 million and 10 years trying to find out what happened to Madeleine McCann, without success.

Sorry everyone but when you say "roommate" are you talking about the accused killer's son?

If that is the case then yes you can as long as you do not accuse him of being an accomplice to his father since there is no proof of that.

It is an interesting look at what happens to a child when they have a parent who is an accused killer.

When Abdulbasir Faizi and Majeed Kayhan vanished without a trace from Toronto’s Gay Village more than six years ago, it may have taken a while for people to realize the men were missing because they were living double lives, friends say.

“Every now and then, I wouldn’t see (Kayhan) for a couple of weeks or a month,” said Billy Gentile, a former bartender at the now-closed Bar 501 on Church St.

“He was in and out of the community. He would come and be around for a while, and then he would disappear for time on end,” and go back to his family.
People who knew Kayhan said he would live in his partner’s unit at the City Park Co-Operative on Church St. when he was in the Village.
Kayhan’s partner also had not come out to his family, Gentile said. Kayhan’s life at home with a wife and kids was not something he talked about.

“He did have substance abuse problems. He drank, and he would get agitated and sometimes violent,” Gentile said.

Gentile said Kayhan was active in the Church and Wellesley area since at least the mid-1990s.
They held his apartment for a year thinking he (Kayhan) might have went away or something, but it turned out he went missing instead,” said Freddy Day, who lived in the same building and described Kayhan as friendly and outgoing. “I think the community is somewhat relieved knowing this has finally come to a head, and the thing that disturbed me is that they can’t find the bodies for the sake of the families,” he said.
Harry Singh, former owner of the Zipperz, said all three missing men and McArthur were regulars at his bar.

Bar-goers used to call McArthur by his nickname “Santa,” Singh said.

“I felt like somebody was targeting my clientele because (all) of them used to come to the bar,” Singh said. “He (Kayhan) used to sing Indian songs to me. They (Kayhan and Faizi) were very quiet, reserved.”
