In Aruba, by Dutch law a suspect is being informed of his rights, such as his right to remain silent, his right to an attorney etc.

Giordano was interviewed as a witness and such will be indicated above his typed witness statements (today, August 5, we interviewed as a witness person such and such).


Someone who does not know what happened is not considered a witness.

Other then that, a witness has no right to remain silent, a suspect has and will be informed of that.

Initially the questions may have been of another nature. The car was not searched etc.
I do not think they asked him the same questions over and over again and Giordano still having the impression he was only considered a witness, I do not think he is that ignorant. IMO

Even if he came in for questioning a couple of times that does not mean they were grilling him, also in a missing persons case (or accidental drowning which Giordano reported) there are lots of questions and things that have to be arranged and carried out, there were just two days in between Robyn going missing and Giordano being arrested (morning of August 5). So there has not been an extensive period in which they could have analysed his statements, interviewed witnesses, and so on. IMO

Someone who walks into the ocean with their 'partner' , a partner they have taken a large life insurance policy on, and returns from the ocean ALONE, is not considered a witness anymore, they are often considered a suspect . And just saying they do not know what happened is not always enough.

Allegedly there was no suspicion a crime had taken place since Giordano was interviewed as a witness not as a suspect.

Had he been a suspect he would have been informed of that and of his rights (such as a right to remain silent, a witness does not have a right to remain silent).

GG was the last one seen with Robyn. How could he realistically not be a suspect? Just because ALE didn't come forth with this information in the beginning, doesn't mean they didn't view GG as a suspect. I believe they did see him as a suspect, they were just trying to get all their ducks in a row before they arrested him. JMO

He had an attorney. He knew they weren't buying his story. I doubt if all of the LE were stone faced while he was telling his story. He has bigger worries here, IMO. Does not look like RF will give up on hounding GG. jmo

We know that GG was with Robyn when she went missing, right? And, he was the only one with Robyn when she went missing, unless of course we buy into the theory he had an accomplice.

Regardless, GG still knows what happened to Robyn. Which, imo, makes him the one and only suspect, no longer just a witness. JMO

On the video T. Stein claims there were big, major, large (not sure of the exact wording but meaning too many) inconsistencies in his statements. Splitting hairs won't change what T. Stein said and it does not change the facts. It's the stories that GG has been telling that don't make any sense.

He was released because they were unable to find her body. If her body washes ashore from currents that are counter to where he claims she went into the water he is busted.

In the meantime he is free to do whatever he wants to do. Everyone just knows now for sure what type of person he really is and hopefully women will stay away from him. jmo

Not only does he go snorkeling with someone who had been taking sleeping pills and drinking, but he didn't stop her from going in barefoot over all the sharp rocks in the area while he was wearing sneakers. THEN she cuts her toe, according to GG, grabs a towel, stops the bleeding, or whatever - come on, why would she even bother with a towel? She was in the water, all she had to do was dip her toe in to see if the wound was deep - and the water would have rinsed the wound. She went back in the water after she cut her toe - Gary tapped her leg at some point and motioned to go back in. He swam for his life, never even looking back...and then she drowned, or was picked up by a drug trafficker waiting nearby.

If this story is true, Gary Giordano has the compassion and conscience of a murderer, IMHO.

I thought it was his sneakers, lol, but it could have been his toupee. Do you know how bad sneakers smell after a day soaked in seawater???? I had those water shoes with me and we had to put them outside soaking in bleach water. Down by the Divi Condos they have loose coral in the water as you first get in so type of shoes were necessary to keep from hurting your feet. So I don't think swimming with your toupee in seawater is a very good idea. lol

May I ask what the point is? I'm being sincere - I'm trying to find relevance in whether or not a witness has the right to remain silent in Aruba. Here, a witness may not incriminate themselves - is it the same there?

Bottom line is, GG was told he was free to go, so he went. He was arrested at the airport because they found MAJOR inconsistencies in his accounts - and I say that because one is not kept in jail for 3 months for minor inconsistencies. I don't need Stein to differentiate for me in a news conference, it's common sense.

GG left the island their main suspect - because there's no body and therefore no cause of death can be determined. I hope her mother continues to push the Aruban and US authorities.

I've known guys with toupees, they were, without exception, weird about having their ruglet touched. There is no way in hades the ones I knew would get into the water.

Even if Giordano can be prosecuted here, should he be? One of the main pieces of evidence against Giordano, the $1.5 million travel insurance policy he took out on Gardner (and she on him), was taken out in the U.S. Moreover, 18 USC 1119 was designed to prevent events such as this: a sophisticated murderer seeking to conceal his crime in a smaller, less sophisticated country where he might more easily get away with his deed.

Both D.C. and Maryland (where both Giordano and Gardner are from) would be appropriate venues for this case. Experienced prosecutors there and elsewhere in this country known what Aruban authorities may not: no body murder cases can be won. If Aruba won’t move forward to give Robyn Gardner and her family justice, then the U.S. should.

I agree - but I doubt they will unless they are pushed, publicly, to do so. It's too quiet. GG is a scammer and a charlatain, it's just a matter of time before he tries to find a way to make money illegally. I think that is what this waiting game is about. I don't believe his business is legitimate, why else would he forge a contract and then try to sue to enforce it?

Just a matter of time...like with Joran.

They could be waiting for the Grand Jury. Grand Juries only meet periodically and it could be months before we hear anything. Statutes of limitation do not run out on murder. They also have to restore his computer files. So it could be awhile and he's not going anywhere. jmo

I believe they were preparing to arrest him anyway because of the insurance policy and questions they already had concerning witness accounts, etc.

Maybe the ticket agent, realizing who GG was alerted the authorities that he was leaving the country without his companion. When ALE realized he was leaving, that's what triggered the arrest at that moment. JMO

I would venture to guess ALE were the ones with a priceless expression on their faces realizing GG was minutes away from getting on that plane!!! LOL

Frankly if there were so many inconsistencies with his account, I am surprised they let him get that far!! JMO They were minutes away from having "egg on their face" once again.

Yep, that is the bottom line of this discussion isn't it??
Why if ALE found" MAJOR in consistancies in his account" they waited until the last minute to detain him is beyond me. I mean what lightbulb went off minutes before he left?? Actually we can argue about those until the cows come home, but the fact is ALE has not provided us with specifics,therefore those willing to use those "inconsistancies" as their explaination for everthing guilty about GG, must use their "imagination" and we know how that works.
