Ah. What is this? Why on earth would this come out now? Are they indicating that they are willing to bargain? I don't understand what this report is or why it would be released. :eek:

I don't get it either. It certainly looks like they know they don't have a chance with all of the evidence against Casey. Maybe it has something to do with the discovery docs Jose has already received. ??? :waitasec: It looks like they will going for an insanity defense.

I thought when mothers suffer this, they don't want to do much of anything, let alone party. jmo

They are going to find her this weekend; maybe the defense is posturing. TES will find her this weekend, and they are skeered.

The defense team HAS NOT acknowledge Casey murdered Caylee. This all has to do with the "death penalty" and how an outline was drawn up with reasons why Casey should not get the death penalty should the State want a death penalty.

The 30-page packet highlights problems with some of the evidence, defines how details in Anthony's case does not fit the state criteria needed for the death penalty -- a penalty reserved for the worst of the worst homicides.

Thank you, Patty. If they're not acknowledging it, then why are they talking about mothers murdering their children? That's what I don't understand. Why bring it up if their stance is that Casey did NOT murder Caylee?

If you kill a child it should be automatic death penalty. Wouldn't that be the worst kind of homicide? Or am I hallucinating again??

But for KC, I prefer her to see a life of suffering behind bars. Nice long life, into her 90's. Everyday may she think of Caylee and what she did.

This was written by that Miami lawyer they've brought in. At least he seems to see the situation for what it is.

Is this normal practice for the defense to submit this even before trial?

We need a legal person to weigh in on this. Someone?????

I agree, it is in response to the charges and an attempt to keep the death penalty off the table. You can also see where they are going to argue the forensics are too new and too unreliable to be used. Regardless of the murder charge, the defense is going to have to explain Casey's behavior and not reporting Caylee missing, and therefore you get the she has been acting odd for sometime.

Evidently the evidence is not good for the defense. I hate it when they cry crazy, nuts, wacked. It's just an excuse. She could have left Caylee with Cindy.

BOMBSHELL TONIGHT!!Somebody better find Cindy and make sure she doesn't have a mental breakdown-she's worked so hard to make us believe her caylee is alive story!

I hope Lawson Lamar keeps the pressure on, and the DP on the table until she confesses completely and Caylee's remains are located.

Yes but since when do you need diminished capacity defense if you didn't do anything? If your child was kidnapped?

I just don't understand this. There has been no trial yet!!

Is this common practice and I just never noticed it before??

This sounds like they concede that Caylee has been killed by Casey. If not, what crime are they referring to in the article?

Here we go with a mental illness defense. Big Surprise! They know IMO that she WILL be found guilty. I thought her friends all said that she had been acting normally... hmm... Either way, Please Casey just tell LE where poor Caylee's body is.

Their job is defend their client, they can start by attempting to get the prosecuter not to pursue the death penalty. They are arguing that cases where the mother killed the child, which is the accusation, don't generally result in a death penalty.

That does not say after her death her behavior was not normal. It says after her disapperance.

What crime? Defense stance has been Casey has done nothing, Caylee was kidnapped, Caylee is alive.

I'm sooooo confused....
