Well, I certainly won't be popping over any time for afternoon tea :D

Regardless of what happened, the fact she didn’t disclose to her guests that she was picking mushrooms in the wild is nuts to me. Anybody experimenting with food and having guests over should give full disclosure. Let your dinner guests decide if they want to gamble with their lives. If a friend did this to me they would soon be a ex friend.

That's exactly why I think it was an alleged intentional poisoning. This isn't like sneaking Broccoli into your child's food to increase their health.

I struggle with the fact that she withheld information from numerous people that could've saved her lunch guests. That is not an action most people who accidentally poisoned people would take. I hope that's taken into account by the jurors

I think alot will hang on what the jury thinks of her character, if they think she is not a person of good character than they are free to accept the prosecutions allegations.........I think they will find her character as shady as ...........IMO

I have a problem with this too. She chose self preservation over the truth. Lied, omitted information, dodged calls. Good character?

Yes, if it was truly an accident, you'd be fessing up that there were foraged mushrooms in the dish possibly Death Caps, where you got them from, and inquiring on the status of your relatives. And requesting treatment for yourself- not be begging off to pack your daughter's ballet bag and feed the lambs. And you wouldn't hesitate to pull your kids out of school to get them tested as well.

Justice Christopher Beale is due to continue giving his final directions to the jury today.

This is the final stage before the jury is sent out to deliberate on its verdicts on three counts of murder and one of attempted murder.

He began first thing yesterday morning (after the court had a long weekend).

While wrapping up yesterday afternoon, he told the jury they would not be sent out to deliberate today.

When that happens, the jury will be put into special accommodation until they reach a verdict.

"You don't need to bring your toothbrush tomorrow," Justice Beale told the jury yesterday.

So at this stage, the earliest the jury will start its discussions is tomorrow.

This is what gets me too-not doing everything in your power to assist after family have fallen ill is inconceivable to me. MOO.

Direction on expert evidence to continue

As proceedings wrapped up for the day yesterday, Justice Beale was speaking to the jury about expert witnesses.

He mentioned two who gave evidence in Erin Patterson's triple-murder trial — Dr Matthew Sorell and Shamen Fox-Henry.

Justice Beale highlighted some of Dr Sorell's evidence surrounding mobile phone data and phone towers.

He told the jury there were "significant limitations" in some of the evidence and that it should not be considered in isolation.

This morning, we expect Justice Beale will continue to give direction on this topic but in relation to the evidence given by Mr Fox-Henry who is a digital forensics officer with Victoria Police.

During yesterday's proceedings Justice Beale told the jury they are to be the judge of facts and should not allow sympathy to affect their verdict.

They were also told to disregard any outside information or opinion they may have overheard from family, friends or associates, particularly given the high interest in this case.

Justice Beale pointed out some inconsistencies in some of the witnesses testimonies including Ms Patterson's estranged, husband Simon Patterson, and the sole surviving guest of the lunch, Ian Wilkinson.

He told the jury they must assess how credible the evidence from each witness is.

He also pointed out some inconsistences that related to a number of topics including whether or not Ms Patterson's children were invited to attend the lunch in question, the source of the mushrooms in the beef Wellington and when Ms Patterson started experiencing diarrhoea.

He highlighted these inconsistencies through transcripts and told jury members it was up to them to determine which account, if any, is accurate.

In regards to Erin Patterson's evidence, the jury were told that if they believe her testimony, they must find her not guilty.

Beale told the jury late on Tuesday, “you don’t have to bring your toothbrush tomorrow,” an indicator that he was not expecting to discharge them until Thursday at the earliest.

He started by giving them an 86-page chronology of the case, which he said they could use to recall matters that occurred during the trial, which is now in its ninth week.

Beale said the jury must follow his directions in order to reach their verdict, but were not bound by any comments he or either party made about the evidence.

The jury should also avoid being influenced by the fact that Patterson admitted making the meal that killed the guests, though says it was an accident, saying the issue is not whether or not she is in some way responsible” but “whether the prosecution have proven beyond a reasonable doubt whether she is criminally responsible”.

The eight topics the prosecution alleged were 'inconsistent statements'​

Justice Beale yesterday took the jury through the 'alleged prior inconsistent statements by the accused'.
He told the jury the prosecution wanted him to highlight the eight 'topics' of alleged inconsistent statements.
The topics Justice Beale listed are:
1. Whether the accused had a tendency to pick and eat wild mushrooms between 2020 and 2023.
2. Whether the children were invited to or free to attend the lunch on July 29.
3. The source of the mushrooms that went into the beef Wellingtons.
4. How much the accused ate of her beef Wellington.
5. How much Gail Patterson ate of her beef Wellington.
6. When the accused claimed she started to experience diarrhoea.
7. Whether the accused knew or suspected the lunch was the cause of Don and Gail's illness only in the evening of Sunday July 30, 2023.
8. Whether the accused knew that Donald and Gail Patterson were in comas by the morning of Tuesday, August 1, 2023.

I wonder what kind of legal discussions are going on behind the scenes this morning.

It has to be that one or both sides is unhappy or dissatisfied with some of Judge B's instructions, IMO.

I hope it is the prosecution asking for some slight changes as well. lol

I suspect it’ll be both sides with issues. IIRC Judge Beale said the comment supposedly made by Simon to Erin about the dehydrator could be treated with caution. That’s a huge part of the defence’s case - if he didn’t say that then she didn’t throw it away in a “panic” bit to cover up murder(s).

Yes, to me that issue is very important as well. If he knew at that time, in the hospital (either as a result of finding out from Erin on that day or with his own previous knowledge) about the dehydrator, wouldn't he immediately have told others, e.g hospital staff, family members, etc. Yet, no one else connected with the hospital or family members mentioned that he had talked to them about the dehydrator at that time. Please correct me if I'm wrong.
