Effective with Erin Patterson's arrest, sub judice is in effect and will be until a trial has concluded. For anyone not familiar with the judicial principle of sub judice, please review the following.

WS is based in the USA but we do try to manage the various discussions to comply with laws of other countries.

As this trial is in Australia, the case is under sub judice so please avoid anything that violates the following principles:

Basically anything that may prejudice the accused’s right to a fair trial
Any suggestion, opinion, or direct accusation that the accused is either guilty OR innocent
(i.e. the accused cannot be called "the killer"; use "the accused", "the alleged killer", or "the defendant")
A defendant’s previous history of any offences is off limits
Scandalizing the court (disparaging judges, lawyers, any officer of the Court) is off limits
Broadcasting anything about proceedings which happen in the jury's absence is off limits
Any non compliance with an Order of the court is off limits

Note in the event of an Appeal subsequent to verdict:
Appeals are usually heard by senior judges who are not likely to be influenced by the media, therefore responsible comment is usually considered acceptable once a trial has concluded, regardless of if there is going to be an appeal.

Posts that are determined to constitute a violation of sub judice will be removed. To avoid this, please review the following from the Victoria Law Reform Commission and post accordingly:

I don't think Erin scraped any mushrooms off, as there were no mushrooms on the meat given to the kids.

Her son said his mother heated up the meat, which she had cooked a day earlier, which was served with potatoes and beans

Senior Constable Adrian Martinez-Villalobis told the jury PATTERSON HAD PROVIDED THE PASSCODE FOR THE PROPERTY GATE AND INSTRUCTIONS ON WHERE THE LEFTOVERS SHOULD BE ..!!

The beef Wellington leftovers were located in a brown paper WOOLWORTHS BAG ( she had that bag handy! ) in an outdoor waste bin, WHERE PATTERSON HAD SUGGESTED, the senior constable said.

One scientist, Camille Truong, results come back negative, as her testing was under a microscope, with a small piece, and most likely the safe one Erin had, and half ate in front of her relatives

However, scientist Toxicologist Dimitri Gerostamoulos told the jury he found death cap mushroom toxins inside the meal's remains when he performed chemical testing.


Erin had this planned, even waiting for the police to turn up and tell them where to find the bin !!

But she wouldn't be happy that Simon didn't turn up to eat his death cap mushroom beef wellington at lunch

Because she threw her safe one out, and the testing has picked up the safe and poison death cap toxin, which has made authorities suspicious

I copied my post over because it was near the end of the last thread and I really want to acknowledge the jurors.


I hope none of the jurors lost their jobs over taking time off work.
I have heard it has happened in the past.

I also hope it hasn't affected their finances too much.
I hope it hasn't affected their personal and family life too much also

Well done to the jurors whatever the verdict.

The Latrobe Valley Magistrates' Court in Morwell, Victoria, operates from Monday to Friday, 9:00 AM to 4:30 PM

We still have 50 minutes for a verdict today!

If the jury thinks it's getting close to a verdict they might decide to use all of Saturday up to the 4.30pm closing.

Just my thinking.

Deliberations have finished for the day, someone please let me know what hours they will deliberate on Saturday? As it's not a court day, does that mean that the verdict doesn't get announced until Monday? That is, if they reach one on the weekend?

It's interesting considering how different life experiences as children can potentially shape our views for life.

Hearing that others have childhood memories of picking mushrooms for their parents is fascinating to me, because my earliest memory of wild mushrooms is playing fairyhouses with them one day. I was stopped and warned very strongly that I must never touch them again as " some are deadly and you never know which ones".

Without giving away my age, I can state that was many years prior to the Canberra incident (if it is the 2012 one being referred to). 😊

So my subconscious idea from that early incident was that "absolutely everybody knows wild mushrooms can kill you and therefore of course nobody risks it"!

do juries there vote in a guilty/not guilty poll when they first start deliberating?
I think a lot of juries do that but it probably depends upon the foreman. It is a logical thing to do as a starting point but not everyone does it that way. IMO
I could be wrong but from Judge in directing jury. From pub “Geelong Advertiser”

Yes, deliberations are ongoing on Saturdays, but apparently they will not read the verdict on Saturdays. Or do I have that wrong?

I believe they if they do reach a verdict tomorrow, that it will be delivered just as any week day

The jury’s verdict or any questions about the case can only be received during regular court
hours, between 10.30am and 1pm and between 2.15pm and 4.15pm, Monday to Saturday. Sunday is a day of rest, but the jury will remain sequestered throughout.

I wonder if the prosecutors have left no options in this trial by requiring a guilty of murder verdict?

If the jury find Erin not guilty of murder, I assume that she is a free person? I wonder if there should have been a lesser charge added so that some kind of justice could be served?

It's so dramatic - 'FAILED to reach a verdict'. I think one of two things is happening: 1) they have mostly decided but want to be thorough and check they haven't missed anything; 2) they're negotiating with the one or two holdouts and understanding what their thinking is and helping persuade them to the majority conensus.

Oh don't worry, even if it was a terrible accident, people died.

She'll very likely have civil cases where she ends up having to sell everything she owns.

I know that thought will make a lot of members of the public happy.

Yes, I agree. I'd very much doubt the jury would be made to wait until Monday to deliver the verdict if it is reached tomorrow.

I think they’re negotiating with the hold outs. No reason for that, just vibes
