Given Tostee did not appear to be on the balcony at the time, murder will be hard to prove.
Although theoretically your client was not on the balcony it makes the murder case a little bit more difficult.

The main reason I am still thinking he could have been out there with Rrie is that he clearly is manipulating the conversation in his favour in other parts of the recording, "where's my money" etc, so I am seriously wondering if he did the same so it sounded like she was out there on her own and was not. Plus, all the death-by-balcony talk earlier... plus "I would, but you've been a bad girl", plus the violence and choking immediately prior, the sheerly abusive, bullying language...

Idk, I can see him contributing to her fall directly. If it's proved he didn't, then that's all good. But right now, I can see it. I just hope the prosecution looks a bit deeper into that part of the recording..

Hey, thank you so much for searching for that post. I think the thread below has the post you were looking for. He states he DOES HAVE a prescription for Ambien but is scared to take it. Then a few posts later he says he took 1/2 of an ambien and asks about Halcyon.

These particular posts are from almost three years ago, but at least we know at one point he had Ambien.

“I then moved to the corner of my balcony and tried to look up to see what was happening above me,’’ she said. “I could see a girl climbing over the balcony from the unit above us. All I could see of her was her legs. One minute she was above me and then the next she was in front of me and then she was on the ground down the bottom.

“I saw her fall all the way."

Ms Collyer-Wiedner told police she stepped out to the balcony to see two legs dangling down.

“The person did not say anything and neither did I,” she said. “In a matter of seconds I saw the person fall from the balcony above mine … I screamed when the person was falling and I think that the person screamed as well.”


--- so the legs here are 'dangling' not 'climbing'. I really hope these witnesses are pressed for details, ie, which way her feet were facing, if they saw her actually climbing over or just hanging there, etc.

I'm imagining a metal chair upturned onto the balcony tiles. Possibly the table dragged toward the balustrade. Just some thoughts.
Tostee's balcony is above and slightly to the side of the neighbours bedroom so think it could be a sudden loud noise.

This case still reminds me of how Simon Gittany murdered Lisa Harnum. The police put in a huge effort to ensure their eye witness was flanked by officers when he went to court.
That murder took place from the 15th floor in broad daylight.

This case took place from a 14th floor balcony at 2:20 am.

Two legs dangling implies to me not supported, ie by the ledge.

It certainly is a horrible nightmare TGY.

Each time I read the transcript and GT saying "get up" "get up". I have this image of him bullying her up/over the rail.
I am not saying this is the case.
It is just those words coupled with the horrific and tragic outcome

Josh Rathwell was a protected witness who saw Gittany throw Lisa over.

I'm wondering if Tostee looked over the edge to confirm Warriena landed on the pavement or to see if she'd made it to the bottom balcony.

I assume he knew she would be dead.

Warriena is hanging off the balcony shouting "no, no, no"

Is he removing her hands? Did she realise she was slipping? Why is she shouting that?

Arrrgh this is doing my head in.
 
In red below is what confuses me. Has GT stopped and taken photos of her body? Otherwise, why would you take a screen shot on your phone of photos that already on there? I interpret a screen shot to be that. But is it clumsy writing, and are they trying to say he photographed her in situ, deceased?

Alot of it is clumsy writing, isn't it. Can't make out if its detectives running on empty (fatigued) or what. Having said that, I don't think he would of gotten close enough to take photos of Warriena deceased, if police were at the scene as he was fleeing.

Makes you wonder thats for sure. How far away from Rrie's body was the pillar?

It will be alleged Tostee hid behind a pillar as police surrounded Ms Wright’s body where he can be seen pacing backwards and forwards before taking the lift to the basement and exiting the building.
