I think any reasonable person would never lock a terrified ( who was deliberately terrified, over quite a long period of time )

All she had to do was sit down out there, calm down, become less irrational, sleep it off there, and we would not be having this discussion. She made an absurd choice no-one could anticipate.

intoxicated ( who was plied with home made hooch to a poisonous degree) .......

It is self evident that is incorrect. She did not die of poison and her blood alcohol reading was nowhere near dangerous levels.

she had no escape from except over it.

Nope, not even close. She had already been put in a safe place by the bloke whom she attacked.

Once that door is locked the deprivation of her liberty

Nope again. She is neutralised...situation de-escalated after she attacked him. Why is that continually ignored?

and her subsequent bid to claim it back all points to murder by Tostee.

You'll have to clarify that, as it makes no immediate sense to me.

Tostee was entitled to get her out of his home, but he didn't. He didn't evict her into the common hallway, he locked out on the extension of his home, his balcony. No way can that be described as getting some one out of your home. You , and I , are not entitled to lock people up on your balcony that has no escape except back into the living areas.. So we can dispense with that furphy for all time, that one isn't going to work..

Nope yet again. He is entitled to defend himself from a violent attack and prevent its repetition. He did so in a most moderate manner by isolating and neutralising her out on the balcony. What happened after that was all her choice.

Do the jury get to listen to the tape while they're deliberating?

they can request the tape and transcript , I believe.. however, that said, they cant keep it while they deliberate for days,.. I would presume they ask for it, listen to it, then return it. Can they ask for it again? I think so. what I mean is they cant have it playing like a loop for days..

When I stayed at the Gold Coast, this event was still raw. The apartment manager was very upset about Warriena, and she was worried about how it would affect tourism.

Of course. They can revisit any of the evidence any time.

I think what happens is, there is an agreement that all the jurors listen to the tape at the same time. . it's not as if one can wander off with the copy and meditate upon it solo.. .. the transcript they can request and keep, but the actual audio, that is subject to certain rules, being played when all jurors are present, played at a certain volume, played at certain times, etc..

I don't know how many times a juror could listen to it. ..closed up in the deliberation room, expected to deliver a verdict... I 'd go nuts in jig time. His savagery was so calculated it is barely possible to listen to once, much less lots..

RSBM - What do you think his plan was?

He put a screaming and, according to some irrational woman, on his balcony at 2.20am. Did he think she would all of a sudden become a quiet mouse?

Was he going to bed and leave her out there all night without a phone, water or anything?

What do you think he was planning to do with her?

It was also a cold night. She would have got hypothermia

However, that tape was so illustrative of her terror in those wordless and wordfull screams. ... that was the real thing, and cannot be forgotten, ever, that it stood alone as its own testimony.

Yes, I listened to that tape once - just once - and could never listen to it again. Those first screams sounded like they were ripping out of her throat. You knew you were hearing a women who was utterly terrorised and terrified, and any decent bloke in GT's position, hearing that terror, would have sat her down on the sofa and called a cab.

So ... are the jury in a motel all catered for, or are they in their own homes tonight?

There was nothing mentioned about them being sequestered, so I imagine that they have gone home to their family - something that Rrie can't do anymore.

He did almost exactly that. He removed her as a threat, de-escalated what he could have finalised with retaliatory physical violence inside the Unit. He acted with appropriate restraint and moderation. He had no time to do much at all, given she began climbing over the balcony virtually immediately. Her choice. Not his, or one a person could reasonably anticipate.

It would be the best thing for society and his parent's bank account if someone took charge of Tostee until he ran out of steam.
Well said Elder Fruit

I don't have any doubt whatsoever about his guilt (manslaughter) - I have doubts thAt the jury will see it my way 😀 The jury is the X factor here

We all know the amount of great sleuthing that goes on here at Websleuths but in this particular case there was no sleuthing needed whatsoever. Tostee handed the evidence to all and sundry with his 'secret tape'. No need to sleuth this idiot at all. Even his past demeanors were splashed all over MSM.

Irrespective of the outcome of this trial, Tostee's life will never be the same again. If he is acquitted, his life will still be hell on earth. A form of prison in itself. Whether he goes to jail or is free to walk among the public, IMO it won't be too long before he stuffs up again. It's just a matter of time really.
