It also says that there is a large amount of surveillance and up to 10 witnesses. Busy public horse riding event or something else?
I cant imagine the logistics of how you’d be stalking a child riding a horse either o_O

I was referring to the assault charges.

I imagine the surveillance and up-to-10-witnesses is going to be about the stalking.

The twist is that the FM couldn't be mentally assessed due to the additional charges that were laid on her. She had been scheduled for assessment, then the additional charges were added, and the lawyer couldn't get another appointment for the assessment in time.

The judge didn't think the additional charges took the matter 'to another level of seriousness'.

The police prosecutor does not have the police brief ready.

The matter has been adjourned for a fortnight, and will recommence in Parramatta Local Court instead - they will set hearing dates and hear the mental health application at that time.

I don't know how these things work. But wouldnt an assessment about mental health be the same test regardless of what charges are brought against someone? Or can you pick an choose

Maybe the FM's lawyer is indicating that FM had a further breakdown of some kind - after the additional charges - and wasn't fit for the test at the time.

I don't know either, but perhaps police ask the assessor for an opinion in relation to the specific charges--why did she do these things, were they because of a mental health condition, what condition. In my opinion there is no one test that would diagnose every mental health condition, and I doubt any condition can be diagnosed on the basis of a single test.

Even so, I thought the assessment was to prove mental health at time of the incident, not after.

Perhaps FM is still not mentally healthy. I imagine a person has to be able to sit and answer the mental health practitioner's questions, during an assessment.

Maybe the stalking incident and witnesses are tied to the child's school.

I don't understand why some of these items they held onto for so long - prams? etc obviously had no one to gift these items to before now. I understand selling items but they would be worth more if sold earlier being a non current model. Just wondering why they were kept.

In December, the foster mother’s lawyer Sharon Ramsden said she would argue to have the case dealt with under the Mental Health Act.

A successful application allows a person who is charged with a criminal offence and suffers from a mental health impairment or cognitive impairment to be spared the possibility of conviction or a finding of guilt.

Sounds to lay person me.......Either FFC has issues that question her ability to care for children OR.........a desperate legal council is setting up for the insanity plea.
