If Brendan gets into rehab, can he get out of a jail sentence? Maybe would not be presumed to be fit for trial, or could have rehab instead of jail?


She spoke with news.com.au in a bid to get her now troubled son Brendan proper drug rehabilitation and mental health counselling.

Oops! I was so focussed on the money, that I skimmed over your questions SA.

I&#8217;m not a lawyer but I have heard of accuseds&#8217; drug dependencies and/or mental illnesses being put forward as mitigating circumstances in sentencing. I suppose it would be up to the magistrate who hears the case but, honestly, if BC is a career criminal (as has been reported in MSM) and he is found guilty of further offences, I can&#8217;t see that a judge would think that a stint in rehab would be a viable alternative to jail time. That&#8217;s the problem when people are addicted to drugs and exhibiting psychotic symptoms &#8212; it becomes a &#8216;chicken or egg&#8217; scenario.

It seems likely to me that NC is putting forward an excuse for BC&#8217;s alleged offences and non-attendance at court after his recent arrest on a bench warrant. She also had an excuse for her own failure to attend court in another matter IIRC. Just quietly, I seriously doubt if William&#8217;s disappearance is the sole cause of BC&#8217;s reported criminalilty/drug addiction/mental illness. The answer may be a little closer to home.

My hope is that William is ‘somewhere out there’ and he will be reunited with his loved ones:

I wonder when this was taken as she has wedding and engagement rings. It must be some time ago because she was hoping to move in with friend maybe 12 mths ago.

:floorlaugh: Believe me, I found the article a little unnerving. I think just about every human being I know (including myself) has varying degrees of some of those traits. The difference is insight. Sadly, many people don&#8217;t have it.

So this other court case that BC failed to turn up for on the same day.
Wonder what that was in relation to?

Blaming her son’s actions on the abduction of Williams is a cop out. IMO she’s setting up the defence for his defence.

Me too. If that&#8217;s true as it&#8217;s been reported in the DM, along with BC allegedly being in possession of a NSWPOL civilian warrant card, I&#8217;d say he may be in a fairly precarious position when he next fronts court.

More to the point, how did the DM find out?

BC has used his "other" name in court before, so not hard to look up. It was in a different court and there is another upcoming appearance.

More interestingly this name was used when his mother (NC) took out an AVO on him in 2015 and renewed in 2016. I understand that Police can take out an AVO on your behalf, however seems it was still in existence for it to be returned to court 12 months later.

I know. You know what I was most shocked about? That she admitted to aiding and abetting Karlie and her son when they were &#8216;in hiding&#8217; with William. If FaCS were aware of that, there went her (and his) chance of kinship care.

She told police to take him away for mental health care, and he ended up in Mt Druitt Hospital.
&#8220;He was arrested for drugs and they let him out [on bail],&#8221; she said.
When?

&#8220;He was put in Penrith Hospital for an infection through his body, he was so skinny.
&#8220;He walked out with pads still on his chest and he was saying to me, &#8216;I&#8217;ve done the crime, I&#8217;ve done some time.&#8217;

&#8220;He thought he had been in jail and then they arrested him because he didn&#8217;t show up in court.

How did he end up in hospital at Penrith? Is there a Penrith Hospital or is it Nepean?
Google says Nepean does have a mental health unit.

He walked out with pads on. I wonder if he was officially discharged or as NC said just walked out?

I guess if he were in hospital on the day of court with an infection all through his body, confused believing he were in jail, that would be a valid reason for not having turned up at court hearings.
All will be documented.

This might have been the MT Druitt hospital reference.
She told the police to take him away and get mental health care and he ended up in Mt Druitt.
Mt Druitt have a 24 hour drug and alcohol service according to google.
They just charged him for drugs and let him go on bail.
Polices fault....
