I was working while listening to the hearing and didn’t catch everything but yesterday (Monday) LVD stated that the subpoenas for defense witnesses were in the hands of OPDS (I am guessing that is office of public defender services or something like that) and should be being served “currently”. Was that an attempt to say they should be served that day? Was there any indication given as to when she filed the request for those subpoenas? Also I know the judge precluded some witnesses, but can anyone tell me which ones he did or did not? I heard him say something about someone also being on the state’s list so they wouldn’t be precluded a couple of times and heard him say if they hadn’t been subpoenaed that they couldn’t be compelled to show up and something about she wouldn’t be allowed to call anyone who had not sat down with the state for questions. So in effect that may preclude everyone who isn’t on the state’s list but I didn’t actually hear him say that or give a date that the subpoenas must be served by - though it seems I recall him saying previously that her whole list was already late. But then LVD’s statement about subpoenas being served currently and his response seemed to leave room that he might allow them if they sit down with the state before being called. Anyway, can someone clear up for me who has already been precluded and who remains as possible defense witnesses?
Also, wouldn’t the OPDS rely on the local sheriff’s departments to serve those subpoenas - at least to those who do not live in Maricopa County? No way could our local sheriff’s department get them served the same day they received them - they’d be lucky if the first attempt was within a week. Surely standby counsel advised LVD that those subpoena’s should have gone out long ago.
