He really is reaching.......but this is the murder of an LE officer and multi-tour Military Veteran. DP or LWOP. Certain populations of the prison will probably get a few extra brownie points for shanking Hulsey once he gets to the Big House.
It was totally senseless, stupid, and unforgivable. Hulsey could have just put his hands up, said he had a fire arm, and off to jail. He would have been looking at a few drug charges and a "prohibited possessor" for the firearm. Probably would have been convicted to a 5 year term. Instead, he goes all mad dog, shoots Holly, fires and returns fire at the other officer, Giotia, thinks he can escape (?!?!?!?!), gets wounded in the leg, and ends up at another witness's (J. Black) door asking for "help" and something to drink.
In the process, he endangered the 2 other suspects, Kostas and Jones, and a neighborhood of condo and apartment occupants.
Here's what bothers me...........Why didn't Ofc. Giotia, after he ascertained that the first occupant had outstanding warrants, wait for Holly and then have each occupant exit the vehicle, one at a time.........back towards the officers, drop on their knees, hands laced behind head (or the whole splayed belly down on the pavement)?
I had the whole "back up, laced hands, drop to your knees, on your belly, arms out" with 5 officers with guns drawn from both the Paradise Valley and Scottsdale PD, when I was stopped for speeding and they found a warrant for me for "Dog at Large" in 1985. I didn't have ANY type of record (I still only have 2 "Dog at Large" offenses as of this date, no felonies) I'll ADMIT: Wearing a pink jail issue T-shirt with MCSO stenciled on it (that my ex had smuggled out of the Durango jail somehow) and a multi-inmate escape from that jail a few days prior MIGHT have added to the scenario. I wouldn't have worn it if I had known I would walk straight into a barrel cactus (I thought I had walked into a landscape rock) that evening while leaving my friend's house. I was just trying to get home to get a pair of pliers to pull those damn stickers out! :tantrum:
It WAS pretty INTENSE.
It was my stupid dad's dogs that I signed a waiver for, HE didn't pay the fine. :banghead:

I don't want to judge this Officer yet.
But when I read the details someone linked above and it said he "ran away" (for cover) when the shooting started it made me pause.
It could be once again bad wording, but I am anxious to hear this in court and how it actually happened.
The 309-page report on the incident offered new details in the slaying of Holly, 24, the second Glendale police officer to be killed in the line of duty.
David Goitia, a Glendale police officer, knew in a flash that he and Anthony Holly, a fellow Glendale officer, were in deadly trouble.
Goitia, 34, ran for his life and Holly, 24, was shot dead Feb. 19 after a man suddenly pulled a revolver from his waistband, getting the drop on both officers, according to a chilling report released last week by Glendale police.
Goitia, 34, realized he didn't have time to draw his own weapon, so he did the only thing possible: he turned and ran, seeking cover, the report said.
Goitia told investigators that while fleeing, he heard several gunshots fired. One of them struck Holly in the head, killing him.
The driver, a woman, was found to have some arrest warrants, Goitia said. A man later identified as Hulsey was a back-seat passenger and was asked to step out of the vehicle.

There was an investigation ("the report") of 309 pages from the Glendale PD. Many of the MSM articles are inaccurate, or just don't line up with each other. I'd like to see the report.:twocents:
Talking to my ex-BiL (ret. LE), there is a SOP for multiple arrestees in a traffic stop (but this may only be his specific precinct and City/State)and the reasons why said vehicle is stopped. Putting my BiL's thoughts under each posed question......below.
If you read the different articles linked to the ABOVE link, you had a single officer stopping a vehicle with 3 occupants, 1 man (Hulsey) in the back seat, and 2 women (Kostas and Jones) driver and passenger. The vehicle (gray KIA) had no license plate. Driver had outstanding arrest warrant (Kostas, I believe, for absconding from detention). 7:00 am on a Monday morning <---it's just starting to get light, possible temps in the high 30's, low 40's, and not much is going on in a residential area except maybe the garbage trucks, kids don't head to the bus stops for maybe another half hour.
First: Glendale started to became a hotbed for crime in the late 70's, early 80's, and they are STILL struggling to bring crime down to pre-1980, they have made tremendous strides on that front.. Drugs, burglaries, stolen property, chop shops, stash houses, you name it.
Did Goitia look at this stop as a "stolen vehicle" and what was the SOP?
BiL: Possible stolen vehicle, 3 occupants, 1 male..call for backup of 2 additional officers, one for each possible suspect.
Did Goitia call for back up when he made the initial stop or after he ran the driver's license?
BiL: Personal choice/gut feeling after watching behavior of the occupants before and/or when the vehicle is approached. If occupants are squirrelly, call back up before proceeding; if comfortable approaching, ask driver for DL and registration, and run for warrants and priors. Possible stolen vehicle gives heed to calling for back up before exiting LE car.
After securing Kostas in the one LE car, did Holly and Goitia have a visual on both remaining suspects and did they "triangulate" their positions with them?
BiL: SOP would be some distance to left/right and in front of 2nd suspect with a visual of 3rd suspect still in vehicle. "Line of Fire" is forefront. 1st suspect is already contained.
So I'm picking his brain, and he does know the Glendale area from visits down there, and it's reputation. But he is retired hard core LE from the Bay Area, SOP would have been "Be prepared for the worst", 2 additional officers, suspects down on their bellies. He did reiterate that every officer has to make his/her own calls, they have to believe they've made the right evaluation of the situation and the potential threats.
Anywho........I think this trial will be interesting and another learning experience.
Holly's family and loved ones have waited long enough to see this part of their tragedy finished.:twocents:
