I hate that anyone gets things that, in my opinion, are not fair. I hate that CA is able to file BK and get rid of all her debt. But if that is the way the system is guess I have to live with it. I just get so tired of paying so much in taxes and the likes of JB and CA escape paying taxes. GRRR

Our lawmakers seem to think that the people that work should have to pay for those that don't. There is no reason that CA and other able body people like her should not be a contributing member of our society and pay their way.

Baez' previous "ethics" attorney is listed on Casey's current bankruptcy filing as a Creditor - Timothy Chinaris.

Baez told Judge Strickland, in the March 18, 2010 Indigency Hearing that he had retained an ethics attorney early on, who had advised him about media deals.

The State was asking how Casey was paying for her Defense, and if Baez had any media deals going on.

Baez said on March 18, 2010, that Casey has no money anywhere - she has been in jail - Baez did not anticipate any money - not aware of any money.

State atty asked - no movie deals, no book deals, no deals for exclusive interviews, no deals for photos, any pending offers

Baez said no and no preliminary discussions

Baez said early on he retained Prof. Chinaris ethics director of FL Bar - and cleared through him
Ethics Prof said - nothing could be pending
Baez said people have made offers - and he politely denied

State asked - What offers received - book deal
Baez denied

Baez said - no, not got to that state

NOTE: With the advice that the Ethics Attorney gave Baez, which would apply to the entire time she was claiming Indigency - through her Appeals process -- Baez could NOT do any type of money making media deals at all, and not even have anything "pending" - and neither could his client.
So, it is not believable that Casey EVER signed a $ 500,000 RETAINER AGREEMENT with Baez, with them both knowing that she had NO MONEY, and no way to "ethically" make money while she was claiming Indigency.

It would be important to know the DATE that Casey says Baez "billed her" for $ 500,000.
And what DATE Baez says he created the "RETAINER AMOUNT" - Baez' Proof of Claim in the bankruptcy case shows that HE deducted payments from the "RETAINER AMOUNT" beginning in "2008".

It is my personal opinion that Baez did not consult any ethics attorney before filing his Proof of Claim for $ 500,000 RETAINER. I believe that he thought the document would not be questioned and would just be processed through the bankruptcy process with ease. It is the responsibility of the bankruptcy Trustee, I think, to investigate and question Baez' Proof of Claim.
 
It is a shame that CA ruined so many lives, not just the one who are trying to get compensated, but her family and friends.

I am ready for the next chapter (not her book, but her life). She will end up on the wrong side of the law again and hopefully she won't escape the consequences.

I think the Judge is correct in that she doesn't have any money of her own. I can't understand how so many people are willing to support her. Maybe there aren't that many, just Uncle Phil. I do believe she has a relationship with her parents and that they are helping her more than strangers/attorneys.

Well then, someone is lying, because either there was a retainer agreement or there wasn't. Apparently if there was one, she didn't know about it or she lied to the court.

I actually wouldn't put it past him to make a claim thinking he can get away with it. He appears to be as much of a narcassist as she is. We're talking about a guy who has had 20+ ethics violations filed against him. I don't believe he thinks he has to walk the straight and narrow ... or cares to anyway .... especially when it comes to $$$.

I believe Baez is counting on the bankruptcy court considering it is not worth it financially, to investigate his Proof of Claim.

I think FCA said that she "thinks" she does not owe Baez any longer.
It is so hard to listen to her voice on that audio of the Meeting of the Creditors on March 4th.

And ... Baez did NOT include money he/she received from the ABC $ 200,000 or from the SPLASH/TMZ staged photos in Ohio on his bankruptcy Proof of Claim.
These events happened AFTER Baez says he consulted with his ethics attorney, and while he was still her attorney on record - he had not withdrawn as her attorney at these times.
 
The Casey Anthony story just never seems to go away. Little makes any sense, but it continues on. This week the team are going to take a long hard look at what is going on.

In the statement of Baz's BK claim you kindly posted in the News section, you are showing a total of $102,568.22 paid to Baez.

Isn't this his share of the ABC payment of for the photos, which was 89K plus a few expenditures?

And isn't the 45K shown in September from "a third party" the amount of the TMZ/Splash photos, of which his "share" was 10,113.79?

Hmm - With respect - I'm wondering if there is perhaps a misunderstanding about the whole invoicing process......ABC wouldn't have paid the photo funds to Baez so the full amount wouldn't have shown up on his records - the money was paid to FCA which is why she is being charged tax on it.

Only the full amount Baez received as fees would show on his records, and it looks like he made a decision re disbursements to justify that amount to show them as payments for the proceeding months. Since the ABC income isn't showing up anywhere else - I think we can assume it makes up the bulk of the $102,568.22

And the timing of the $45,000 payment makes it pretty obvious this is the TMZ/Splash income. Didn't FCA say she waived payment for these photos? And didn't she say she received a gift of $3400?

Re: Income from the Dr. Phil monies - I thought AZ told us FCA didn't need to report gifts of money?

For me it's not about what Baez is reporting - it's the why of it that is important. But I respect we may have a difference of opinion here and I appreciate the listing work you are doing.

Edited to add - the reason why I suggest the above is because $89,454.83 + $10.113.39 + $3000.00 = $102.568.22 - the amount Baez has declared as his income.
 
I'm not a lawyer ... but my reading of this document stating the bankruptcy judge's RULINGS from the last Hearing on June 25, 2013 and his reasons for the rulings, sound like he is extremely favorable to FCA, and extremely likely to DISCHARGE any claims by Zenaida and Kronk before they even go to any jury.

Zenaida and Kronk Motions for Relief from Stay - DENIED
cannot proceed with civil suits in State Court in Orlando

Judge gave Zenaida and Kronk 21 days from July 1st to file a Claim and an Adversary Proceeding to object to Casey's discharge and/or their objections to the dischargeability of their claims.

This bankruptcy judge has jurisdiction to decide the claims of Kronk and Zenaida and to decide if Casey is ineligible to obtain a discharge or whether any claim is allowed against the estate, or whether any allowed claim is excepted from discharge.

Bankruptcy judge says there is nothing in the record or the pleadings to counter debtor's sworn assertions that she has no meaningful assets or income.
Her attorneys are working without a fee.

bankruptcy judge would have to conduct a second round of litigation to determine whether the statements made by Casey, or on her behalf, was a "willful and malicious" injury under the Bankruptcy Code.

If the Zenaida and Kronk claims are found to be dischargeable, a state court jury trial would be meaningless in this "apparent no-asset case".

Bankruptcy judge says he needs to first determine the discharge issues, before any jury trial. Zenaida and Kronk have not shown sufficient cause to justify a jury trial in state court BEFORE a determination of whether their claims are dischargeable.
 
Looks to me that despite documents to the contrary, Baez worked on the understanding he was to get another $500K at a later date when she was able to cash in on her notoriety. Now Casey denies knowing anything about that.... ( I am SURE I would know if I owed an attorney that much).

IMO that is what all her Pro-Bono attorneys are now doing. Once all the debts and potential of Zenaida/Kronk/TES lawsuits are dispensed with, she can
cash in with interviews and then they can all stand in line to submit their bills.

I think this is the Judge giving them a second chance. It's as if he is saying - what you have given me isn't going to cut it - please do some searches and see if you can up up with some other precedents so I can do something for you here.

He pretty much said the same thing to ZG and RK. IMO of course.:moo:
 
Sorry, but every time I see the words "ethics" and "lawyer" used in the same sentence as "Baez," I just take a fit of laughing. :floorlaugh:

The only hope I think we have in this case is good ol' Uncle Sam, in the form of the IRS. Unless you're a corporation with a staff of legal eagles who work to keep the IRS off your butt, if you owe them a red cent, they will hunt you down like the hounds of h#ll. They did it to me one year (long ago); I muffed up my tax return and they garnished my wages..and I owed them only a small amount of money. NO sense of humor, that dastardly IRS.

SO...I see this team of not-so-wise guys having to pay the piper one day, a la Al Capone or John Gotti. They got away with murder...but they didn't get away with not paying their taxes!

Here's hoping.
Wesley Snipes just did 3 years in federal prison for tax evasion. Lauryn Hill was just sentenced to 3 months. These are celebrities that have actually contributed something to society, as opposed to some baby killer that beat the rap. Don't mess with the IRS! :jail:
