*Trial continues (Day 10) (@ 9am ET) - PA - Andrea Constand (31 at the time) (Dec. 2003-Jan. 2004) - Bill Cosby (65 at time of crime/now 80) accused of 3 counts of aggravated indecent assault charges. Pled not guilty; free on bail. Mistrial in June, 2017. The 12-person jury consists of seven men and five women. Six of the men are white and one is African American. Four of the women are white and one is African American. The six alternates consist of four men and two women.
Defense started their case on 4/18/18.

Did “DR” Harry Milman, expert witness for the defense, testify in BC’s first trial too? Is there anyway to find out which of BC’s lawyers ‘found’ this expert?

I cannot imagine why the defense hired him at $675.00 an hour, to testify with no medical license, he could not answer questions that pertain to the case, who admits his source for written report and testimony were based on looking on the internet, who said he is a ‘toxicologist not a forensic toxicologist’, is not board certified, among his publications he uses a letter to an editor and two books of fiction and coils not answer basic questions.

This did not help BC at all. What were defense attorneys thinking? They should have known the prosecution would investigate the credentials of all experts throughly and ‘grill’ them on their knowledge. This is sad, really sad.

Cosby lawyers want jurors to hear from accuser’s confidante

NORRISTOWN, Pa. (AP) — Bill Cosby’s lawyers are scrambling to make sure jurors at his sexual assault retrial hear from accuser Andrea Constand’s confidante before deliberations get underway next week — but they’re having trouble getting the woman to cooperate.

Sheri Williams isn’t responding to subpoena attempts, Cosby’s lawyers said. Now they’re seeking a judge’s permission to read parts of her deposition into the record just as prosecutors did with Cosby’s old testimony.

Judge Steven O’Neill is expected to rule on the request on Friday.

Constand testified at Cosby’s first trial last year that she and Williams were good friends and would speak “at all hours of the day: morning, noon, and night” and were in touch as she went to police in January 2005 with allegations he drugged and molested her about a year earlier...

Yes, thank you.....and I was afraid of that but not dutprsied at Cosby and his teams tricks.

Once a man I like and no longer can respect....lost it 10 years ago when at one of his shows....but I never ever thought he would do what he did.

Interesting! We called ecstasy “beans” in my day (90s). Maybe it’s due to the evolution of the “magic beans” or “cool beans” phrases over time. I wonder what drug holds that nickname now.

( I was too young to know what they were then - just heard the name and never saw any. Uppers and downers were also another common name for stuff I knew nothing about just heard people discussing at concerts etc. I was too busy with my head in school books I guess. :innocent: )

I agree with this ruling.

The defense had tons of time to get ready for this trial and so long as the witness is still alive then they should have been able to find her and use her if she was still willing to testify in court to whatever it is they wanted.

It tells me that this person got cold feet and does not want to commit perjury on the stand. It sounded like pretty damning testimony if they could have gotten their star witness and something is real fishy about it since they cannot produce the witness.

Its a little different than the judge allowing BCs deposition to be heard. He allowed that because the defendent was obviously not going to take the stand and if the defense wanted to cross examine the deposition from BC all they had to do was put him on the stand.

This is a little different IMO because its a 3rd party witness that is claiming something. So she should have been available if she still wanted to claim something. The prosecution has a right to cross examine any witness testimony usually.

I guess the big question is why was she not available?
Wonder what the real story is about her.

Does anyone think there was any truth to what she was saying on the deposition about hearing Andrea Constand scheming before it happened to try to frame a celebrity for a bunch of money and claim the celebrity took advantage of her?

As a child of the sixties, I had to laugh when I saw Cosby's defense team talking about anyone 'becoming hooked on" or "addicted to" hallucinogenic mushrooms.". They are not an opioid or opioid-like drug.

I hope this jury convicts.

See, I can't understand this BBM. If someone is subpoenaed aren't they forced to come to court ? Would 'not responding' be against the law and probably result in imprisonment? I thought a subpoena was enforceable?
Always difficult to compare different law in UK & USA, but be grateful if anyone could explain. How do the jury take into consideration this behaviour?
