Body of missing Oscar Hernandez,13, found in Southern California [Oxnard] - Soccer coach charged

Mario Edgardo Garcia-Aquino (dob 10/24/81) was charged in case 25CJCF01825 with one count of murder with the special circumstance allegation of murder during the commission or attempted commission of lewd acts with a child, making him eligible for the death penalty. He is expected to be arraigned tomorrow in Department 30 of the Foltz Criminal Justice Center.


On March 30, the teen was reported missing by his family after he boarded a train to Lancaster to visit Garcia-Aquino and wasn’t heard from again. Garcia-Aquino is accused of killing Oscar and then dumping his body in Oxnard.

 
And HOW did he remain a coach???? It said the name of his soccer team/league or whatever, I didn't catch it though. I'm sure it will be in an news report soon. These leagues/schools/ etc have to be held responsible as well. IMO My husband and I coached, soccer/cheering/baseball/softball some for the school and some for the township and I was active in my childrens school and activities/trips etc. We had to get a background check/FBI check/finger prints for the school and township. ONE CHILD IS TOO MANY!!!

They must have some pretty solid evidence to say that the murder occurred on March 28th. usually they will give a on or about date. I think cell phone pings are going to play an important part in this investigation and probably DNA.


 
Aaand they are encouraging undocumented folx to report his assaults and promising no repercussions. Predators prey more when you make a population more vulnerable. These poor boys.
I suspected that would be the case. The worst sort of predator, he not only groomed Oscar - but his family as well. Most of us here would be highly suspicious of a coach who asked if our child could spend the night at their home. But we read about these cases day in and day out. Oscar's family was completely duped by this monster. I'm heartbroken for them.

Oscar’s older brother, Daniel Hernandez Jr., told the San Fernando Valley Sun/el Sol that he “wants to see justice” and he’s glad that the authorities “are on the right path” to make that happen. He said he hopes that “anyone else who was hurt by him will come forward.”

The murder charge includes the special circumstance allegation of murder during the commission or attempted commission of lewd acts with a child, making Garcia-Aguino eligible for a potential death sentence.
 
So if he initially checked out clean in a background investigation. How long would it take or what is the process for notification if someone working with youth is accused of a crime? Is there a process for that?

So very heartbreaking. It does take a village to raise a child, but when evil enters the village, the pain will never go away.

It sounds like prior victims had the courage to come forward and yet nothing/not enough was done to pursue justice for them nor protect future victims, in my opinion. I would love to be wrong, but that's what it sounds like.

How must those victims feel? I admire them for having tried to get justice for themselves and others.
 
How would nobody in his circle find out that this guy was arrested for something even if he ended up not being charged? I would not want this guy in a position of authority over kids even if charges were dropped.

Unless the logic was, "Well he wasn't charged so it must not be true! Let's let him around kids all the time!" which is unfortunately very common...(not victim blaming, just questioning everything).

I'm interested in how well they knew this coach. I think we can only imagine what happened.
If anything, this is a cautionary tale. You really have to be so vigilant and ask questions.
 
For the past 20 years I have coached and mentored more sports and clubs than I can count. You'd be amazed how many parents were perfectly fine with dropping off their children and never even meeting me. I think they want to assume the best intentions of people who work with children, but I can assure you there are plenty who work with children to have easy access to them for nefarious reasons.
 
My husband coaches and I recall he only did background once. A good handful of our league staff work at schools so they do it more often through their job but not the league. So if the guy already passed background before the accusation last year I can see how it may have fallen through the cracks. I bet leagues will be rethinking that.

I feel this is cultural. Where I live, it wouldn't be weird for a 13-year-old to go to a lesson/practice/training alone. If the teacher/coach was known and trusted and holding an event at their house, it wouldn't be weird for a 13-year-old to go without parents. Parents would probably pick them afterwards if it was dark outside, but if they didn't have a car, and the coach or another parent offered a ride home, they might accept that.

It’s a blessing that Aquino was located and arrested so quickly.

It's horrible, but I cannot understand them letting him go on a trip alone with someone they barely know.
I feel like a lot of parents are still way too trusting, way too passive in the face of danger
