If you look at the tweets (how many hours ago) from a few of the reporters in the courtroom, it appears it took approximately one hour per juror of questioning before they were chosen and sworn it. So doing the math so to speak, looks like they are going to need another day or two to finish up choosing the remaining eight. JMO and guesstimation.

Yep. And I'm sure i read that if they don't find 8 suitable jurors from the remaining group, they start again on Monday from step one...calling in potential jurors to see if willing and able etc. I am sure everyone is hopeful they can find the 16 from the first round of people.

I don't think they move the date of the trial up, even if they finalize the jury today. That date would be firm since it is the date the lawyers are working with and I am sure the newly selected jurors need some time to get their lives in order before committing 4+ months of their lives to the trial.

Not quite. They have today and Monday to find eight more jurors. The process restarts on Tuesday if they don't succeed.

Thanks for adding the clarification. I read "next week" and assumed Monday. And you know what they say about assuming...

Also I wonder if those alternate jurors will sit through the whole trial and then be excused when it's time for the jurors to deliberate or if the alternates will be let go once the trial starts? I always thought they kept all jurors until deliberations started, but in MR's trial, alternates were excused before the trial started. MOO.

Hi Swedie ... in the recent Dennis Oland murder trial http://www.websleuths.com/forums/sh...d-69-brutally-murdered-St-John-NB-7-July-2011 the alternates sat through the whole trial until deliberations began and they were excused

The judge said it was the hardest thing for him to do after they sat thru the whole thing. I bet the two excused jurors were pizzed too. I know I sure would be.

I believe in the recent Jodi Arias trial that I followed, the jury was chosen without naming the alternates even though there were about 6 extra people. At the time of deliberations, the actual jurors who would deliberate and decide on the case were pulled from a draw. So you had several who sat through the whole thing but were then not able to deliberate at the end. And they didn't know going in that it would be them. That's got to be even tougher. I know they were very disappointed as jurors are allowed to speak to the media after a trial in the US. But it was certainly necessary to have a number of extra people in that trial because the defense team spent a lot of time trying to disqualify jurors to get the numbers low enough for a mistrial. Not to mention the colossal delays that were affecting some jurors lives. I believe the 6 alternates were down to 2 by the end of the trial.

Only 6 jurors to go and it's not even noon. I like this no nonsense judge so far. He really should be giving classes on how to run a courtroom to some of the others, particularly in the GTA.

I really don't understand why the alternate jurors were dismissed in MR's case and didn't get to sit through the whole trial. Why bother picking alternate jurors then? Had they been needed at some point in the trial, they wouldn't have heard testimony and seen witnesses and evidence. In Canada a jury can be reduced to 10. Any less and the judge would declare a mistrial and start over. MOO.

Jury selection took place last week and 12 people were selected to serve, along with two alternates who will be dismissed once the evidence starts if they aren’t needed to fill in.

http://www.news1130.com/2012/03/05/tori-stafford-died-from-repeated-blows-to-the-head-jury-hears/

A jury in a criminal trial is initially composed of 12 jurors. The trial judge has the discretion to direct that one or two alternate jurors also be appointed.[40] If a juror is discharged during the course of the trial, the trial will continue with an alternate juror, unless the number of jurors goes below 10.

Actually swedie, the link I just posted seems to have information there about alternates only being used prior to evidence being presented. :dunno:

(1.1) A judge may select another juror to take the place of a juror who by reason of illness or other reasonable cause cannot continue to act, if the jury has not yet begun to hear evidence, either by drawing a name from a panel of persons who were summoned to act as jurors and who are available at the court at the time of replacing the juror or by using the procedure referred to in section 642.

SC writes:

In total, the jury will be composed of 14 people, plus two alternates. This is larger than the standard 12-person jury, due to the expected length of the trial, which could take four months.

Typically, the two alternates will be cut on the first day of the trial — they're only in case someone drops out before it begins. Then, there are two "extras" who will serve for the duration of the trial in case of an emergency.

But only 12 jurors will deliberate a verdict in the end.

The jury pool in this case — 1, 800 people — was also larger than normal because of the publicity surrounding the case, and the challenges of finding people who are willing and able to serve for such a lengthy trial.

Agreed -- I don't think they will move the trial start date -- the jurors who have already been selected are depending on that date, too. And one more thang,

They would/should have been pleased knowing that they would have done their duty as citizens, but they didn't get the cherry that was on top of the sundae. Two emotions, I'm guessing: satisfaction and frustration...

Members and guests can now cast their vote on "What do you think the verdicts will be?"

As noted in the opening post, the poll will close just prior to the commencement of the trial and we won't have another poll until after the trial has ended.
