ok......dumb it down for me......do we have lawyers who represent people who can't afford to pay for a lawyer and is TD one of these? I just don't remember reading that the tax payers were paying for TD. I may have missed it......

I should have added IMO.....I distinctly remember reading that at one time when he was first arrested even DM thought he might apply for legal aid.
I think it may be commonly accepted that MS is not able to personally fund his own defense ( no wealthy family etc) so I would expect that he could apply for legal aid...or possibly luck into defense counsel who was willing to work pro bono......But that is strictly my own opinion.

Jury now being recalled.
by Adam Carter 3:48 PM

Fraser now asking a couple of other questions.
by Adam Carter 3:50 PM

Fraser asking about whether you can see the safety in one of the photos. She says you can see its edge.
by Adam Carter 3:51 PM

The overall length of the Walther PPK is just over six inches, court hears.
by Adam Carter 3:54 PM

Plath says it's hard to gauge whether or not the Walter is a small, medium or large handgun.
by Adam Carter 3:55 PM

Millard's lawyer Ravin Pillay now cross examining.

Pillay suggests shed need specific gun - not just model - to determine that. She says there might be slight variations gun to gun. #Bosma

The Walther PPK has been manufactured for many years--since 1931. Many variations on design. #Bosma

Walther PPK first released in 1931.

I wonder if you are able to discharge big legal debts through bankruptcy?

Pillay now showing an image of a small handgun that the jury hasn't seen. It looks like a Walther, but the image quality isn't nearly as good.
by Adam Carter 3:56 PM

Plath says the safety on this gun looks similar to a Walther PPK .380.
by Adam Carter 3:57 PM

Pillay asks if the logo on the barrel of the gun is "in agreement" with a Walther PPK. "The image isn't the clearest, but it's the general shape," Plath says.
by Adam Carter 3:59 PM

The text on the gun can't be read, but the three lines of writing can be seen with a smaller font on the top line, which is also seen in the example photo of the Walther.
by Adam Carter 4:01 PM

The location and the shape of the magazine release is "in agreement" too, she says.
by Adam Carter 4:03 PM

There's also an insignia just over the grip, and the banner shape is like the reference photo of the Walther PPK.
by Adam Carter 4:03 PM

No magazine can be seen in the photo Pillay is showing.
by Adam Carter 4:05 PM

Plath again says she can't say if the gun in this photo is real without examining it.
by Adam Carter 4:07 PM

The ejection port can't be seen in this photo. "You don't know what distance the cartridge case is ejected from this particular firearm?" Pillay says about the Walther PPK. She says no.
by Adam Carter 4:09 PM

Pillay is asking about ejection velocity and placement because where the case landed and where it came from has been a point of contention.
by Adam Carter 4:11 PM

The Walther was first released in 1931, Plath says. It has variants based on the same design.

They don't always sit in the prisoner's box. DM and MS are sitting at a table behind their lawyers since there was not enough room to sit at the same table as their lawyers.

Agreed. DM and MS started out in the dock and were moved to a table with computers on Feb. 1st.

Pillay suggests she doesn't necessarily know that it's the exact same model she is comparing against w the RCMP database. #Bosma

molly hayes ‏@mollyhayes 55s56 seconds ago
She says they will change name if something is changed significantly. But re: small variations across diff years it's possible yes. #Bosma

Dungey asks to address court in absence of jury. Jury excused.

So has RP introduced a blurry photo of a Walther replica to try to stump the expert? :waitasec:

Pillay about to move to another photo, but now Dungey wants to raise an issue. Jury is sent out.

My sister is a lawyer that does the criminal side of Legal Aid. She generally does bails, pleas, or sometimes gets charges dismissed/stayed. No trials for her, she has a daily docket to clear. Her title is Duty Counsel.

If you're eligible (based on what your situation is and financial need is) you get a certificate saying so from Legal Aid Ontario (government organisation) , which you then take to a lawyer of your choosing that takes certificates and it will "pay" for a certain number of hours.

Hahaha.....you might want to consult your lawyer about that

They don't always sit in the prisoner's box. DM and MS are sitting at a table behind their lawyers since there was not enough room to sit at the same table as their lawyers.

Why wouldn't each defendant be sitting at a separate table with only their counsel then? I don't think that is possible in Canada. Have we ever seen that in a case where the defendant is not out on bail? :waitasec:

I think most, if not all, defense attorneys do some legal aid work and they just come up in a rotation for appointed cases perhaps? This just happened to be TD's "turn" for an appointed legal aid case? And I don't think he would have wanted to turn it down considering the notoriety of the case.

:hilarious: I just knew we were in for a few chuckles at Pillay's expense.....Nice catch.....

We have seen instances in the past where a lawyer has taken a case knowing that it was going to be high profile...essentially...advertising his business. He may have agreed to work for whatever legal aid is offering just to have his name in the headlines. (assuming legal aid is involved.) MOO

Yes. They were in the prisoner box during jury selection but were moved to be with their lawyers on the first day of the trial.

That's exactly what I was thinking. Oh man, this DM defence is torture. Is it really going to matter at the end of the day? Think the Jury is going to say...whoa- there must not have been a gun?? MOO

I like how RP uses a pic of MS holding the gun.
