I am going on what the media posted about the subpoena's. HT and TWC I think it was, were the only 2.

K&B posted, "These were Brad's only trips to any store that morning." BC himself went into HT to get his transacation history so he knew which ones to have them ask for. I personally don't think they sent a subpoena to all the local stores, just blowing smoke IMO.


I would imagine that they would trust their client if he said he didn't go anywhere else...so there wouldn't be a need for other subpoenas.
 
I agree. I don't think that you'll see the Coopers fighting for visitation. The kids are with the Listers in Ontario which is quite a ways from Medicine Hat, AB. Before all of this, the Coopers saw the kids about twice a year. I don't think that will change. Maybe they'll still send letters and cards and make more phone calls to the kids to try and foster a better relationship but I don't know.

Sadly, I don't know if the Listers/Rentzs will be bending over backwards to bring the kids down or invite the Coopers up to Edmonton when the kids come to Alberta. I think there's going to be some bad blood between those families. I would hope that NC's dad, from his previous employment position, will recognize the importance of including BC's family in the girls lives but I think right now, it's going to be very very difficult to see past what has happened. Particularly as this goes to trial. BC's family is still going to stand up for him and defend him and I think that makes it hard for these families to meet in the middle for the sake of the girls.

Just a really sad, heartbreaking situation. :-(

Yes, that is SH and he has since removed any references to BC from his blog. It's possible his feelings have changed or at least become somewhat mixed (I'm speculating).

Trust their client? How can a client be trusted who has continually been caught up in his own web of lies? Det Daniels & NC friends/family vs BC shows he lies. BTW...so far many of NC friends affidavits are proving to be true, hearsay or not.

Already today, the N&O is showing he lied during his deposition about his affairs with other woman. D E P O S I T I O N

Some want to believe he would NEVER lie during the deposition, not BC he would never risk it, he knows what would happen if he did, etc, etc.

He is narcissistic, he will lie, he thinks he is better and smarter than the law and everyone around him.

FWIW...BC went to HT to get copies of his transactions from the morning of July 12th. Why? This was well before K&B submitted the tapes and receipts for the public to see.

It has been quite a difficult week with a lot of mixed feelings. A bit of a roller coaster emotionally but Monday was probably the worst of it when the indictment came down. Still hard to see the arrest played over and over again in the news up here.

I can only imagine your feelings, knowing him the way you do and having that connection to friends and the community. My mouth was on the floor and stayed that way a good long while. To say I was shocked was an understatement--I just never expected they'd indict this month, let alone anytime during the remainder of 2008.
 
Hi Everyone. I have been following this case from the second I heard NC was missing. I've been silently reading all your posts for some time now. SG, I really appreciate all your knowledge of the legal system & your sense of humor. It brings relief during a sad time. Mom & SG thanks so much for the time you have put into the custody hearing. It keeps everything so much closer to the heart to have first hand info.

I felt BC was guilty of NC's murder from the minute I heard he didn't call the Rentzes about her being missing. Was he afraid he might feel too guilty if he heard the sound of their voices? Was he afraid he might break down at the sound of their voices? Or was he too ashamed because he knew they knew "too much" about his & Nancy's marriage?

Anyway, with Brad being a Canadian citizen, there is NO WAY he will ever be put to death. If he does in fact get the DP, there will be a huge outcry here in Canada, because apparently we Canadians do not believe in the DP. Irregardless of his punishment he will be extradited to Canada and then OUR justice system takes over. If he gets LWOP he will be out in 25 years. He will be 59 years old - young enough to start a new life. If he gets LWOP & is sent to ALberta, he can apply to have the 25 yrs. shortened. He has been a model citizen up until this point, you know. If he just gets life, he will be out in 7/8 years because I'm sure he will be such a good boy in jail.

I don't think it's an automatic extradition. If he was given the DP, then they would move to extradite, to "save" him. (ETA: Based on Maja's link, I guess we don't do that anymore either). Otherwise, I think they'll leave him in the USA. Canada would spend it's life and all it's money if they extradited all criminals back to Canada.

You're right though. If he was brought to the Canadian system, LWOP is max 25 years. Parole eligibility begins when he is 2/3 of the way through the sentence. Not to mention all of the credit he would get for time served prior to the trial. Time in remand is credited at double time (wait one year for trial, get 2 years credit). I wish our justice system offered real justice, maybe it would deter more people.

Thanks for the info, Maja. That is a relief. Hopefully BC will stay in NC & know what it is like to be in PRISON not enjoying life in our "Club Feds."

Hi CentralAlberta! WELCOME and so glad you are joining in the discussion. I don't know what our current agreements w/Canada are, but you raise an interesting thought! Thank your for the nice compliment--I'm always looking for levity in any situation, even tragic ones.
 
I guess for first degree murder, parole eligibility can not be reduced to less than 15 years:

But again, with time served, they usually end up incarcerated for less than that anyways.

I hope NC goes for the DP.

If he's given LWOP - couldn't he apply to serve his sentence in Canada? I wouldn't want that to happen here.

I'm not sure if that is an option. Because LWOP in the USA, from what I understand, means you never get out again. A life sentence in Canada is 25 years max and then you get out, unless you're deemed a dangerous offender. Would the US look at that as a reduction in his sentence if they transferred him here?

I wonder if any of the posters who are more familiar with case law know about something like this and how it would work?
 
I have to bet he's VERY close to getting his US citizenship - so he may not be the most desirable person for Canada to go to bat for.

I also have to think that if they are considering this as a capital offense, that the DA has contacted the proper Canadian authorities prior to an arrest, or at least immediately after to discuss / insure that Canada would not stand in the way of a DP prosecution in this case.

He's been here for 8 years - he's not a "new to the US" Canadian unfamiliar with the laws, etc.

I see this proceeding smoothly - and him NOT getting to go to Canada - ever again - under any circumstance.

...not quite so. He'll most likely return to Canada someday....to be buried.
