Nima Momeni (found guilty of 2nd degree murder of Bob Lee) has a new 2-person defense team that tells me they will file a motion he didn’t get a fair trial. Possible reasons: quality/sufficiency of prior counsel, juror concern &/or admission of pantomiming video. Pg. 1


Could be “months” before new counsel has court transcripts. New attorney tells me Momeni is “optimistic.” June 4th new date to set sentencing date. Pg. 2

So tomorrow is the court date to set the sentencing date. I hope they don't set the sentencing date too far into the future, as Bob Lee's family deserves justice.

As already known, June 4, 2025 is the new date to set NM's sentencing date. No info being reported at this time.

The sentencing delay is due to the fact that Momeni is appealing his conviction and his new legal team has to be brought up to speed on the case.

In a lot of cases a defendant found guilty by the courts is sentenced in spite of their attorneys filing an appeal. I don't understand why the court is delaying sentencing just because Momeni is filing an appeal.

Attorney Daniel Shriro, who now represents Momeni, said he needed time to review “all of the transcripts” in the case before sentencing takes place.

The judge, although amenable to the delay, said that it could take some time for Momeni’s attorneys to get the full transcripts because of a nationwide court reporter shortage, noting the situation was “unfortunate, but completely understandable.”

“I need to make sure this doesn’t slide unnecessarily while still making sure Mr. Momeni gets the representation that he is entitled to,” San Francisco Superior Court Judge Alexandra Gordon said.

Even so, the judge pushed for a status check from the defense lawyers sooner rather than later.

“I am not going to wait six months just to find out what’s happening," Gordon told attorneys.

Very strange. So when did the new attorneys come on board? Why would they be given time to come up to speed on a conviction that isn’t going to be affected by an appeal?

Does a legal response to the sentencing have to be on the record at the actual time the Judge pronounces it?

I guess it could be because NM's attorneys have to speak on his behalf at the sentencing, perhaps present mitigating factors to try to get him the lesser sentence of 16 years and not a sentence of life in prison (the max sentence). I guess they could argue that they need to be up to speed on the case in order to give a proper representation at sentencing. But I imagine they will drag this out, buying time for Momeni. And then their appeal will go forward. In the meantime, Bob Lee's family have to wait for justice. I hope their civil lawsuit against NM's mother and sister is proceeding in the meantime.

Tomorrow, on August 22nd, there is a scheduled status hearing for Momeni. I hope the judge will set a date for the sentence hearing as soon as possible and not drag this out longer. Bob Lee's family deserve justice for him.

I certainly hope so, the convicted killer NM was found guilty of murdering Bob Lee last year. Poor Bob Lee's family. I'll be away so will check back next week. Hope you or someone else is able to keep us updated. :)

During the hearing, Momeni sat between Shriro and another new attorney, Boris Bindman, wearing a bright orange sweater and taking notes.

The next hearing in the case will be a status check on Aug. 22, where Momeni's counsel will check in with the judge concerning their progress.
