It strikes me as odd that neither the defense nor the prosecution are calling Boivin to be a witness. And yet I don't know what he would contribute to either side while seeming to be a key player in the Khazar and Nima drama.

Nima Momeni on the stand in the Bob Lee murder case: Momeni said he wasn’t upset with Lee and Momeni knew his sister wasn’t sexually assaulted, undercutting the argument put forward by the DA.


So far, Momeni’s testimony appears pretty credible. He says he talked with Lee, Boivin and a friend of his sister—all of whom told a story contrary to Khazar and her alleged assault.


Momeni has also told the jury details of his life in Iran and why he left with his mother and sister.


An accented Momeni has spoken about his sister’s open relationship with her plastic surgeon husband, her track record with drugs and her inconsistent and fanciful stories.


Momeni has also testified that he was on good terms with both Bob Lee and Jeremy Boivin, the man who prosecutors and Khazar have said sexually assaulted her.

Momeni testified in San Francisco Superior Court about phone calls and text messages the day before the stabbing, in which he tried to piece together whether an outlandish story his sister Khazar Momeni told him was true: that she was sexually assaulted by Lee’s drug dealer and friend Jeremy Boivin. By 9 p.m. on April 3, 2023, Momeni said, he had been dispelled of the notion that his sister had been sexually assaulted.

Defense attorneys showed the jury text messages that took place April 3 between Momeni and Lee, after the defendant called Lee to learn more about Boivin. “Thank u again for talking to me, good timing,” a message read. That message was liked by Lee.

The prosecution has begun its cross-examination of Nima Momeni. There have been numerous prickly exchanges between Momeni and prosecutor Omid Talai, who made clear with the tone and tenor of his questions that he believed Momeni's version of events was a "story." "Your story is that this prominent, beloved, respected man, he wanted to kill you over a dumb joke?" Talai asked, referring to Momeni saying it was a "dumb joke" when he told Lee he would rather be with his family at 2:30 a.m. instead of a strip club. Momeni had testified Lee invited him to go to a strip club with him.

2:32 p.m.​

Momeni testified he and Bob Lee were hanging out together and that the mood quickly changed after Lee asked Momeni if he wanted to go to a strip club. Momeni said Lee took offense when he said no and that he would prefer to be with his family. "That set him off," he said. Momeni said that led to a confrontation under the Bay Bridge outside Momeni's BMW. He says he saw Lee take out a knife from his jacket pocket and lunged from him. Momeni said he deflected the blows and Lee ended up getting stabbed in the chest. Momeni said he saw the knife on the ground and threw it over a fence because he didn't want Lee to retrieve it. Lee then casually walked off while on his phone, he said. "Did you know Lee was injured," defense attorney Saam Zanganeh asked. "No," Momeni replied. "Fatally injured?" "Absolutely not," he said.

Nima Momeni began his testimony by admitting he was going through a range of emotions and that public speaking was not his forte. His attorney Saam Zanganeh led him through an introductory background, explaining how he, his younger sister Khazar and their mother left Iran to get away from his abusive father. He dabbed at his eyes with a tissue as he spoke about his father and apologized for being "emotional." Fast-forwarding to the night before Lee was killed, Momeni said his sister called him, asking him to pick her up because of a "bad trip" at a party where drugs, including GHB, had been supplied by Lee's alleged dealer. Momeni testified he found the situation "very unsettling" and that he was upset at the alleged dealer and not Lee.

The background regarding escape from Iran and abusive father seems to be introduced to get sympathy from the jury, not sure what it has to do with the charge of murder of Bob Lee.

Agree. Is he claiming childhood trauma, ptsd? Escaping Iran? He is an adult now and he had/has the choice of going to therapy.

Gaining sympathy is the angle. I would object to that having any relevance. How does that relate to Bob?

WHO IS JEREMY BOIVIN? (Read last half of news article...IMO a shady kind of guy)
Court records show that Boivin’s brushes with the law began in 2020, when he was accused of drugging his housekeeper with GHB and sexually assaulting her while she was unconscious.

The bags also held numerous baggies often used for drug-dealing, two police radio signal jammers, a gold bar, two silver bars and more than $30,000 in cash.

The defense appears to be all over the table. First it was Khazar claiming she had been sexually assaulted. But now on the witness stand Nima Momeni is stating:
Momeni also said that he knew his sister had not been sexually assaulted in the hours before Lee’s killing. (implication being she tells fanciful stories and shouldn't be believed? )
AND NOW,
"As to Khazar’s initial claim that Boivin had assaulted her: “It sounded like something my sister said, being emotional, trying to get attention,” Momeni said."
If I find the defense difficult to follow, then it has got to be difficult for the jurors, too. Suddenly we have gone from drug fueled party, accusations of date rape, defending a sister's honor, blaming Boivin's actions on Bob Lee....to now claiming Bob's death was the result of him not responding well to a "joke."???????
Hmmm, sounds to me like the "throw it all at the wall, and hope something sticks defense."
Anyone see it differently?

I wonder how the defense and/or prosecution will address the fact that the knife came from Khazar's condo apartment, so if Bob Lee was the one who produced the knife after Nima's joke, why did Bob Lee take a knife from the condo in the first place? He didn't know there would be a joke that offended him so much that he tried to stab someone to death. On the other hand, we know that Nima was very upset with Bob Lee that night, even Khazar's texts sent to Bob Lee state that.
