Yes, and he testified that his regular phone went missing when him and Monica went to South Carolina and his laptop was stolen out of his vehicle shortly after the murder. You just can't make this stuff up .. oh wait .. lol

I'm really struggling today to figure out why the defense are choosing to play all of Christopher Austins proffer. I'm sure they think something is in there that will impeach him .. but so far all I'm hearing is his regret and embarrassment for getting involved and what seems like a man trying to remember everything and be as truthful as possible.

Austin was asked (in this proffer) if they went in the open sliding glass door or the front door, I couldn't make out which he said, could you?

I didn't catch that part .. I am going to have to go back and listen again. I am only catching bits and pieces right now.

I wonder why neither side has called Birdsong to the stand? Or else I’ve missed it. He must know a lot.

Since he hasn't been charged with anything (yet), I doubt he'd do anything except take the 5th unless they gave him a full immunity deal.

Thank you! That's what I thought Austin's testimony was but it got a little confusing between pros. questions and his answers.

P.S. That wasn't Baker's testimony, he said they went around back and in through the open sliding glass door. Austin's testimony/proffer is another point favoring Monica's involvement (leaving the front door open or having left the keys for Baker).

Yes, MOO, this is becoming a very dragged out trial. Poor Jurors. I wonder if this is necessary.

Very curious to see and hear this Birdsong person. That's what I've wondered,-- why didn't either side get him to testify at this trial? Would like to know much more about Birdsong, who he is and how he played into the murder of Fabio.

Was he, Al Birdsong, arrested back in Dec. 2024 in Texas? Is he 66 yrs. old? Seems he might've been being held in jail in lieu of $2 million bond?

Wow, I didn't know he'd been arrested. I thought it came up during trial that he hadn't been charged/arrested in connection with this. I must have misheard something.

From what I'm gathering, this witness was called back, I think, to clarify what he disagreed with on Monica's chart of, I guess, what she thought she was entitled to? (I'm missing the timeline here.) Mr. Rubin is saying he disagreed with certain points having to do with the PEG stock options post-death compensation, and something to do with alimony. To Mr. Rubin's knowledge until he got a letter from Proctor and Gamble he didn't know about those options, Monica did not mention them. and in 2023 they would've been approaching expiration. He prepared a chart as well showing the discrepancies.

Monica had calculated what difference over evaluation of stock options. If alimony was involved a $900,000 figure was calculated figuring Monica would've been eligible to receive $90,000 for ten years, etc., if they had divorced. Monica didn't seem to realize she might've been better off divorcing Fabio and not going to murder for insurance gain.


Yikes, Court TV saying they aren't sure Prosecution did prove that Monica conspired to have her husband murdered.

Arrested December 2, 2024.
Found this, says Birdsong was released after LAPD interviewed him and decided not to pursue action against him. So strange.

Released December 4, 2024. Only held two days. (I saw that, but that article was behind a pay wall for me until you posted the link here.) He was arrested Dec. 2nd and released Dec. 4th according to these news articles.

Did he bond out?...no, it says they interviewed him. Just a guess that maybe he had a firm alibi that proved he was not present or not near the murder scene or even in town then. Not enough to hold him?
