Just watched Part 1. I dont think the defense made much headway.
I will have to watch again because hubby kept talking to me about a movie he was watching and I had to politely pretend to be listening...
The D tried hard to normalise the calls from CM to QB, trying to get her to say there was nothing unusual or untoward about his requests to cancel online QB and that it is also quite normal for people to call about other peoples accounts, as if they were that person.
I don't think he succeeded though, especially after the cross exam, where she hammered some of those attempts by adding more critical info to the discussion.
The D was really leading her at some points, trying too get her to say that one big reason people would want to cancel online QB and transfer to desktop is if they are worried about someone hacking in remotely from another computer...[ Implying it was really Joey wanting the change because he was worried about DK?]
And the D emphasised that one call was a request for the instructions for how to transfer data to the desktop version. So it was not an unusual request.
But the cross was very effective, in my opinion, bringing up the information that the transfer was never made. So essentially Joey would be deleting all his data if he had them cancel the online QB because he never transferred any of it.
And she got the QB supervisor to admit that would be 'a bit unusual' for someone to do that unless they were going out of business.
Also, the D tried hard to make it seem 'normal' that someone might call in and make requests about a different person's account and the field office worker would not know or care. And he highlighted that by saying ' there is no connection to a bank account in QBooks,right? '
And she answered that's correct.
But I think the jury will haver the same reaction I did, which was ' unless someone had blank checks for that bank account" .....
And that is what the P did during cross. She pretty much described what Chases did, with the checks, and then said would that be a reason someone might want to delete another persons QB data?
A flurry of objections but she did get it in there...
