Just watched Part 1. I dont think the defense made much headway.

I will have to watch again because hubby kept talking to me about a movie he was watching and I had to politely pretend to be listening...

The D tried hard to normalise the calls from CM to QB, trying to get her to say there was nothing unusual or untoward about his requests to cancel online QB and that it is also quite normal for people to call about other peoples accounts, as if they were that person.

I don't think he succeeded though, especially after the cross exam, where she hammered some of those attempts by adding more critical info to the discussion.

The D was really leading her at some points, trying too get her to say that one big reason people would want to cancel online QB and transfer to desktop is if they are worried about someone hacking in remotely from another computer...[ Implying it was really Joey wanting the change because he was worried about DK?]

And the D emphasised that one call was a request for the instructions for how to transfer data to the desktop version. So it was not an unusual request.

But the cross was very effective, in my opinion, bringing up the information that the transfer was never made. So essentially Joey would be deleting all his data if he had them cancel the online QB because he never transferred any of it.

And she got the QB supervisor to admit that would be 'a bit unusual' for someone to do that unless they were going out of business.


Also, the D tried hard to make it seem 'normal' that someone might call in and make requests about a different person's account and the field office worker would not know or care. And he highlighted that by saying ' there is no connection to a bank account in QBooks,right? '

And she answered that's correct.

But I think the jury will haver the same reaction I did, which was ' unless someone had blank checks for that bank account" .....

And that is what the P did during cross. She pretty much described what Chases did, with the checks, and then said would that be a reason someone might want to delete another persons QB data?

A flurry of objections but she did get it in there...

Defense so sincerely doesn't want Imes to get the PayPal 3rd party user info in front of the jury.

Important testimony out of the #McStay trial today. Defense PayPal witness on the stand. Defense alternate suspect Dan Kavanaugh used PayPal debit card in HAWAII Jan. 7 to Feb 27, 2010 showing his alibi. Defense asked if he could have given card to another.

Dan Kavanaugh PayPal records show he bought airline ticket for $390 on Jan 6 and from Jan 7 all the way to Feb 17, 2010, transactions are from Hawaii #mcstay

Regarding Joseph McStay's PayPal acct: JM added Dan Kavanaugh as a 3rd party user on 10-10-2007 and from 2002 to 2010 there were 505 transactions between the two. #mcstay

I have just finished part 3... I just wanted to quote these tweets and just say, these are so unreliable and I am so disappointed in the errors and lack of reporting from the court.

First, Cathy's was a typo.. it should have said Feb 17th.

Second... I am not sure that this 3rd party thing means what the prosecutor wants it to mean, but even if it did the record also shows that CHASE MERRITT was added as a 3rd party in October 2007 as well (but I see that was left out of the tweet lol) Oh and... when Summer Martelli was added as a 3rd party... it was added as summer martelli (all lower case) on Feb 3rd.

From what I got from that testimony was... the debit card "appears" to have been used in Hawaii during that time frame based on the names of where the card was used (it does not provide IP's) But somewhere along the way the IP address changed, IIRC Jan 26/10, which Maline "promised" us that we will hear all about that later LOL I have way more notes, because there was a lot of info in there, but I'm listening to Part 4... computer forensic dude!!!!

I honestly don't think it means what Imes is trying to say it means, I am not a 100% sure though, and if it does... well, what does it say that he added Chase in 2007 as well?
There is way more interesting and questionable DK activity in that testimony than what he attacked in cross IMO. Also, I think Imes came off a bit strong with a witness that was only there to answer questions... she has no stake in this trial, it's not her family members involved, she has no connection whatsoever, no need to be a d!ck IMO

His name was already in the Contact account (different QB account) They do not share merchants. The contact account had pages and pages of merchants. The custom account had 4 merchants in total in it's drop down box.

DP case.
Trial started 1/7/19. Dark on all Fridays. 8 women & 4 men (alternates include 4 men & 2 women).

It's pretty late here and I may not have understood correctly, but was everything the computer guy talked about re the QB activity around 8:00 p.m. on the 4th simply to say no checks (or anything else) had been printed? Didn't we already know that? As well as the 6 google searches that had been run before and were selected again?

Annette Bron - Intuit, in 2010, she was a 6 yr employee, a sales manager at the time, Ryan Baker worked under her at some time, she wasn't sure if it was exactly at that time.

so from part 1 - Merritt did download Quickbooks Pro from the online download Intuit provided to him when he called. A CD of Quickbooks Pro was also mailed to Joseph McStay at the same time, but the CD install was not used.
