Wondering if BS/ Apotex did comply or were about to comply, with the deal to record conversations and report on his competitors and rivals? speculation, imo.
Oct 2021 rbbm.
Barry Sherman’s Apotex has paid $100 million to answer U.S. price-fixing allegations and agreed to help investigate competitors | The Star
''In the U.S. government case, Apotex admitted to a conspiracy to “suppress and eliminate competition,” escaping a criminal conviction that would likely have barred it from the lucrative American market, according to the U.S. Justice Department. As its part of the deal, Apotex must co-operate with investigations of rivals, including recording telephone conversations, introducing law enforcement to sources, or testifying before a grand jury, documents filed in court say''

''Sources close to the Sherman family and Apotex say these agreements and potential liabilities are complicating the Sherman children’s plan to sell the Toronto-based firm.''

''In addition to the payout, Apotex agreed to help U.S. justice officials investigate other generic firms, including (if asked) recording phone calls with officials from other companies, testifying before federal grand juries related to the investigation, and setting up a corporate compliance system to “detect and prevent criminal antitrust violations” in the future.''

It is weird, I have saved a pile of news articles on my hard drive (in case they disappear), and I did a search for 'executor' on all I have saved, and not much has been mentioned at all about 'executors'... the only real mention or reporting of the same in articles that I can find, is this from KD's book, wherein it seems KD is of the understanding that the executors and trustees are one and the same in this case?

ETA: It seems everywhere else that I can find, they are referred to as 'trustees':

KD's ebook pg 222 (from my perspective, yvmv)
'Barry's will was a simple document, created in 2013 and described by a lawyer who saw it as being "not too far removed from the boilerplate will you could get from Staples." Should he die before Honey, it set up a "living trust" to look after his wife, under the guidance of four trustees. The names of those trustees were changed in 2015 and again in 2017. When Sherman died, the trustees, which are sometimes also called executors, were [JS, AG, JK, and AS's] husband, [BK] - an all-male group of trustees. [JK] had been on a mission in 2017 to add a fifth trustee so that if there was ever a contentious issue, there would be a numerical tiebreaker. Sherman was having a hard time finding someone to act as an additional trustee, according to one businessman who said he passed on the offer because he did not want to get tied up in Sherman family politics. As to adding a woman, someone who had in-depth discussions with Sherman about that issue observed that Sherman had chauvinistic tendencies and had commented "I cannot have a woman, they are too emotional."'

"Sherman was having a hard time finding someone to act as an additional trustee, according to one businessman who said he passed on the offer because he did not want to get tied up in Sherman family politics."

Maybe this is why JS suggested AP, BS wanted a 5th, the daughters were out and JS could have been attempting to block FrankD from being an option?

Yes, I was also wondering if FDA had been invited to participate.

ETA: Could've also potentially been his original partner, Joel Ulster. In KD's book, he referred to Ulster as B's best and oldest friend:

KD ebook pg 266 (yvmv):
Joel Ulster, Sherman’s oldest and best friend, is easily moved to tears well over a year later.

And contrast the above with what JS's husband stated JS's reaction was when he first heard the news; seems like such a calm and emotionless reaction to me, but noted the aunt was very distraught.:

Standing in the cottage driveway after the call from his aunt, “Jonathon told Fred that his parents had been murdered and that they were found in the basement and that his aunt was very distraught,” according to the police account of Fred’s statement.

Barry Sherman owed $1 billion and was not going to pay, police documents reveal

I think we can scrap the Joel Ulster idea since B had already dismissed 2 of his previous 'trustees'/executors(?) (his two brother-in-laws), as they were both getting older, almost as old as B himself.. and Joel was I believe the same age as B... which leaves FDA as one I can think of that B would trust enough to take on that task.. but I can't see it??? What about Desai? That apparently wouldn't have gone over too well either? Any other ideas? Or were there no other ideas, and that is why there was never a fifth one chosen? imo.

It would be interesting to see what was available at the time for rent. I'm guessing any place with cameras would have been avoided, like a hotel or building with security.

The Apartment building at 44 Stubbs would be my first choice for a safe house, then the Rental Townhouses just south on Woodsworth Road.
These are ideal locations; you could drive by Old Colony daily to and from your residence and draw little attention; both locations are within walking distance; both locations have underground parking.

Because of the large number of people living at either of these sites, it would easy to blend in. Cameras would not be a concern. Wear dark generic winter clothing, blend with others and as experts they would know how to stay in the shadows.

With large complexes like these, a few units were likely becoming available each month. I am assuming the planning began in summer & fall of 2017. Has somebody checked the occupancy records from back then, yet?

Here are some photos of the Stubbs apartments. What I'm wondering though is whether they would be furnished? Seems to me like they would not. Would a hit man furnish an apartment?

Is anyone familiar with the Oriole Go Station? I'm a little confused about where it is. Is it actually underneath the 401? Could the NW have walked to it from within the neighborhood?

Edit - never mind, I see the maps that were posted earlier. So there is literally a walkway out of that subdivision to public transit.

The only way AP would or could benefit from the Sherman's deaths, would be through the windfall his business partner JS would receive.
If JS had lots of money and invested it in his and AP's company, AP is pretty well assured the financial viability of their joint enterprise. However AP has to be very confident that in the future, JS would not say " AP I do not need you, I got lots of my own money, Goodbye".

Potentially, AP could be an accessory rather than an initiator. IMO

AP may be a graduate of the Ivey School of Business but I question his business savvy. I was looking up how much it would cost to start up a storage unit business. It can vary in Ontario, depending on location. Considering JS borrowed upwards of $70 million off BS it doesn't appear to me to be a great profit making enterprise. What on earth did they spend all that money on? Is the storage business a front for some other business they have going? It makes no sense to me they've spent so much money. I realize that some of that money went to other ventures but it's the one that JS mentions the most.

it’s a real estate play. Imagine the appreciation in the value of their properties around the GTA in recent years. In the interim, storage units generate cash flow.

True! In this drama about how the McD's chain was built, it was all about the land...
The Founder Film Summary & Review | by Constance Döring | Medium
''In order to build an empire, Kroc came to the realization that it was not only the restaurant business he was in, but the real estate one: he needed to buy the land he was planning to build a franchise on to secure his restaurant.''

I did a little map of the day that HS supposedly updated her will. BS lawyer was noted as Davies Ward Phillips and Vineberg LLP which is located at 155 Wellington St West way down near the lake. Next is her meetup with the "friend" at St. Clair and Yonge. Next is the Loblaws to get croissants, presumably the one on St. Clair Ave. Finally, the trip back to 50 Old Colony.

My questions based on the map are:
1. Was she traveling alone that day without BS? If so, why? If the will was in his name why wasn't he there?
2. Was HS someone who was comfortable driving downtown by herself? Did she ever take public transit? Was she driving that day?
2. Why meet at St. Clair and Yonge? Did she actually go to a different lawyer that was closer to that location?

More questions than answers I guess. All speculation IMO and based on the unsubstantiated report from her friend.

BS wouldn't have driven that route; she'd have gone down Bayview. It would be a lot quicker and less hassle than going the other route.

There are numerous law offices on Davisville Ave and Yonge St in that area.

I doubt that Honey would walk too far considering she had issues with arthritis and replacement joints. HS didn't strike me as a woman who would be afraid to drive in her own city. She probably knew it like the back of her hand. Apologies if this has already been posted.

Self-storage was considered an excellent business venture a few years before JS jumped in. I only know this because my brother who is a savvy investor researched it years ago and tried to get into the market, but found buying an existing storage company had become extremely expensive . It is needed, it is low maintenance and it doesn't require much time or effort to turn a profit. But, you needed big bucks to buy into it, and my brother was too late to capitalize on the growing demand before prices soared.

JS got involved after my brother looked into it, and BS apparently was happy to fund the business venture. It may be a very profitable business despite what JS had to pay for any existing companies, or the cost of any rent or buying land and building new storage sites. It is difficult to determine if Green Storage (now 8 locations, and one in Toronto) was a good business venture compared to the apparent high dollar investment. I recall Lexiintoronto said that JS had asked BS for $50 million to buy a new storage location, per KD's book. My sister borrowed my book and left town, so I can't look this up, but I think the storage/warehousing business is/was a hot market and the cost to get into, and expand the business was astronomical. I wonder how the pandemic has affected it.

Imo, I think he was likely referring more to potential decisions that may need to be made now and then about perhaps staffing issues, layoffs, etc., and females perhaps becoming too emotional in the employees' potential circumstances in potentially being laid off, in contrast with making the hard decisions that would be best financially in the company's best interests.

I think BS was a product of his generation, especially as someone who worked in the sciences. I also think his gender bias came from years of learning and working in a male dominated profession that was very far removed from the realities of dealing with sick people, family strife or young children. No emotion needed or wanted in the discovery of medical breakthroughs in a lab.

The cash flow is peanuts in comparison to the initial outlay. As a real estate play it sucks, imo. JS owns a storage unit in Orillia and several years the county decided to turn the road his storage unit was on into a dead end where before it was a not-so -easy off from highway 11. When you're buying up property like that it pays to know why the seller wanted to sell and to check the county plans for future development that may negatively affect your purchase. Check out the map of Harvie Settlement Road on Google maps. You can see the ghostly outline of where it used to be. I doubt the business partners did that. I moved to this area in 1993 from Toronto when the population in Orillia was 24000 people. Today it's 34000 people. Not a good standard of growth for future business potential, imo.

Here's an article in a local paper dated December 2016 regarding the closure.

I'm confused about the timing of that article which is from December 2016. According to this post on the Green Storage site, they opened Orillia Green Storage in May 2017. It sounds like it was an existing storage business that dated back to 2005. Did they not know at the time what was going to happen to the road?

Exactly what I was talking about. Where is the business acumen evident that JS cherishes so much in AP if they bought a business then complained about a county change that would negatively affect said business when the road rerouting was already in the works?

Just a point of interest.... on the Green Storage blog, there were no posts in October or November 2017. In December there were posts on the 12th and 22nd. The post on the 12th looks pretty sloppily done. I'm curious who is writing the posts for their site? I would say that they were pre-scheduled, but the erratic posting schedule suggests otherwise to me.
