The only thing I can foresee the defense coming up with is multiple different explanations for each piece of evidence. I can't envision one defense theory to explain away all of the challenges the state will throw their way at trial. This in itself is a red flag to any sensible person judging the guilt or innocence of Casey. They, the defense, will have to explain away the decomposition evidence as either junk science or attack chain of custody and contamination (the ole defense lawyers last resort). A different explanation will have to be offered for Casey's behavior after the crime and if they are thinking about "ugly coping" I don't think thats going to fly...the pictures at Fusion show Casey coping quite well with her daughters disappearance. Jose likes to cite Cynthia S as an example of ugly coping, but Cynthia didn't loose a two year old child...there is a difference. Cynthia lost a husband, from Casey's reports when she was at Fusion Caylee had been kidnapped, she was missing. Plus Cynthia's case did not have the amount of evidence that Casey's has, but I guess Jose has to take what he can get. The people Casey said existed, but didn't, Zenaida, Jeffrey H., Raquel (outcry witnesses) have never been found (not even a picture exists and we know Casey liked to take pictures). Her whole life is chronicalled in photographs with the exception of these vital witnesses (her phone records also don't contain these fictional characters numbers, and we all know how Casey loved that phone). What Jose's explanation for that will be, I don't know. Maybe he will say that, by implicating Zenaida, she was covering for someone, but after this much time in jail that person still has not been identified and jail time would bring that info out from Casey (she would have given that up on day 31, more likely on day one). She has shown the ability to throw anyone under the bus in order to save herself, I doubt a jury will buy that she was trying to protect her daughter, her family or anyone else by withholding the name of the killer.
By attacking the evidence with a thousand different scenarios the jury will know that the defense has no sensible explanation for Caylee's death other than the obvious...Casey killed her.
