Could injury have happened on Dec 21, 28th? Answer: could have.

Defense asking if death could have occurred as late as 12/28/07 and doctor said yes it could have. No further questions.

IMO, the testimony about SUBSTANTIAL force knocks back the theory that Christina may have done the deed.

I understand, but swinging a crowbar into someones head is substantial force... whether male or female.

Witness excused.

BUT, ME says it's possible it was ONE BLOW. That's pretty substantial.

A trained Marine of either sex could use "substantial force", IMO.

I'm thinking blow with crowbar, base of neck hurt by wall/floor from fall or slam. More like a whiplash kind of injury. I'm not sure by any means though.

Prosecution rests.

Wonder if in that heated moment (I'm guessing) what would have happened 'if' the crowbar wasn't nearby??? That is, hoping he didn't already have it 'ready'.

Hmmm, wonder how a crowbar could fracture the BASE of the skull? I'm thinking he slammed her into something like the wall or floor. :furious:

He could have hit her on the base of the skull with the crowbar to incapacitate her so he could deliver the final blow.

Here's another Marine murder where a similar thing was done:
"Col. Sabow was rendered unconscious or immobile by a blow to the head that fractured the base of the skull . . ."

Bothers me that prosecution didn't make a point that she was naked from the waist down.

I wonder if the defense will offer any theory on that, such as a consensual liason interrupted when they got caught? :waitasec: MOO

I am just thankful that Maria did not suffer more than a few minutes. Actually, Dr. Clark did say that Maria would have been rendered onconscious (sp.) from the force of the blow to the head and heart and brain activity was not likely after a few minutes.

I am literally sickened by all of this.

Defense moves to dismiss some of the charges. Robbery. He had her pin.

  • #358
Prosecution argues he didn't have it til the third attempt.

  • #359
Motions to dismiss are denied. YAY.

  • #360
Attorneys are back in the courtroom addressing the judge. Defense motioned to have some charges (robbery, use of ATM card, etc) dismissed. Denied.
