Can one of our resident attorneys explain to me why he is allowed to show and argue against opening and closing statements, which the jury is instructed are NOT evidence?

About the Trooper on the 8th Mr Maline. CM BURIED the MS Family on the 6th and then planted the Trooper on the 8th to make people believe they went to Mexico.

I could understand if he would be promoting 'doubt' in their minds - saying, in essence, there's not that much direct evidence, you deliberated for 5 days, if you're not that sure, then don't vote death. But instead, he's boring the jury to tears rehashing the case. They are probably watching the clock, just waiting for this to end, so they can get in the room.

I don't think though that we'll get a quick decision, I think it will be at least a day, because they took 5 days to reach a verdict, and that tells me the foreperson is letting everyone have their say. This is a horrific decision to have to make, especially if you have any lingering doubt, and people want to talk through their emotions.

Does the prosecution get a rebuttal, or once he stops droning on, is it just jury instructions and off to the jury room?

Retrying the case, insulting the jury? Not a good strategy imho.

I just rejoined Websleuths. I was here throughout the Arias trials, but life took me away, and when I tried to reactivate my account they couldn't find me so I created a new identity. Glad to be back!

I remember reading on the astrology thread a long time ago, I don't know who it was but she/he kept saying the chart was saying "look at the house". I don't know how I feel about chart reading but that has always stuck with me.

I think the jury is going to come back real quick on this. Maline is insulting their integrity.

And McGee can only be worse with his shouting and hysterical-sounding angst.

IMO, this might have been an effective strategy in closing for the guilt phase. The reason he did not give this closing in that phase is he knew when the PT got up to deliver rebuttal, they would absolutely obliterate him and the smoke and mirrors he's trying to sell. He's doing it now because he knows they don't get another chance to address the jury. I still think it's the wrong strategy, it's insulting to the jury and the work they did to come to a verdict, and it will backfire.

I can only speak for myself, but my answer is a resounding YES!

I didn't post much prior to the bodies being found nor much afterwards in the old threads.

I'm just not interested in rumors, conspiracies or speculations of who the unknown suspect (at that time) could be when it's all actually based on nothing, but unsupported wild theories.

I did from time to time read some of the posts occasionally convincing me I did not want to participate in any of it which was chocked full of victim bashing, iirc.

I didn't watch the TV shows about it either, but by happenstance when flipping through the channels, I happen to see CMs interview on CNN iirc.

It was then I felt CM had murdered the McStay family, and until then I didn't know much about him. It was one of the most chilling, and revealing interviews I can remember.

Iirc, I do believe I posted CM would be the one arrested for all 4 murders. So I wasn't the least bit shocked when it came to pass since I expected it would happen one day if anyone was arrested for their murders.

Also, iirc, I was in the minority opinion at the time.

Others seem to have selected their own suspect long ago, and dug in even further on who they had speculated was the suspect.

I'm sure on many other blog sites they are still pushing their own prior theories, rank speculation, and biases even now.

The facts in evidence are what matters to me.

Imo, There is absolutely no doubt CM is the murderer of all four victims. No amount of spinning is going to ever change that either.

Being in San Diego, I was very much interested in the disappearance of the McStays and tried to follow the trial but there was too much to wade through to get to the facts.

If I was one of these jurors and this guy basically told me he hopes I can live my life with the guilt of my incorrect decision, I would be furious. Sheesh.

The comment about "character assassination" is real rich coming from the defense. Maybe they could ask Mikey, Dan, or McGywer about character assassination?
