Clarification of Expert Witnesses WARNING!! snippy

  • #101
The cadaver dogs are but one "indicator" that something was very wrong.

Considered alone, they certainly can NOT prove a "dead body". Anyone can argue that they may not be relied on as "proof" of death.

BUT...

when the canine alerts are combined with 31 days, gas chromotography, zero cooperation from family, duct tape, and other pieces of "circumstantial" evidence, they support a theory.

Short of video, a case like this is as strong as the sum of its parts. IMO, the sum has not been tallied yet. But it's looking pretty high.

JB wants to get as much thrown out as possible in order to reduce the "sum".

JMO

ITA. I look at a case as a puzzle. You have to fight to keep in the pieces that allow you to see the picture. JB is trying to eliminate enough pieces that at least one juror won't see the State's picture. Reasonable doubt.

:rolling: LOL (i'm slow) I finally figured out what you ment in the warning...Warning SNIPPY..you ment "snippy' the newly famous testifying dog...

Yeah, I'd have to say it's pretty ridiculous that JB is suggesting since the dogs can't be "cross-examined" they shouldn't be allowed in. It's common sense what the cadaver dogs do and what it means when they do what they do. What, is his next move going to be to say that the coffin flies shouldn't be allowed in because they can't be questioned? Or maybe the smell of death not allowed since it wasn't "bottled up" that first day? This gives us a pretty clear view into what his defense is going to be.

IIRC, this is why they took down the red-light "gotcha" cameras in Virginia....cameras cannot be cross examined....maybe GinnyL told 'em about this and they got to thinkin'....

How simply the defense wrote this up reminded me of a very old Eddie Murphy skit, he was making fun of some dumb sports players

"Football is my life.
If it watn't for football...
I wouldn't be a football player today".

That is about how much was explained in this list...so and so is a botonist..
he is an expert in...well botony, of course...
if he gets called to the stand he will make faces and point at the state's botonoist to criticize what was opined about....botony.
Otherwise...who knows?
Unless it is Wednesday, and his shoes are brown...he will talk all about botony. Yes, botony, that's right.

It is offensive that the defense makes a mockery of the judge's ruling this way. The interesting thing is it appears to have originated in Cheney's office. With his thirty plus years of practicing criminal law, he must have written scores of these, so for him to feign ignorance along with Jose....is even more offensive!

What seems lost on them is they do not win points, they only put off the inevitable. Meanwhile as they stall, May gets closer. They run this case ten minutes at time, much the way Casey tells such easily disprovable lies.
I would sure love to see their file list of priorities, for entertainment purposes.
For my good friends who are Florida taxpayers, indeed it isn't funny at all.

I was most interested to see that Dr. Lee lists Taiwan as being part of the ROC on his resume, so I Wiki'ed Taiwan to learn more about how that whole controversy is going over there...
That should give you an idea of how bored I am with JB's antics.

Yes, and the judge already replied about this that many, many, many times canines are relied upon, whether the dog was alerting on human decomposition, bombs, or drugs. He may have even used such things in his cases when he was a lawyer. So Baez may as well be reinventing the wheel. If I were the defense I would be busy looking up prior cases in Florida, that are on point. You bet your life Judge Perry's clerk's are going to.

The defense absolutely, without question, is going to be a garbage in garbage out trial strategy. Someone was mentioning the other day that it was odd how Cindy commented there were no hair, no fibers, no DNA. Where she heard those sentences very likely was Linda Kenney Baden. That was her mantra every interview. In one interview she articulated all of that, and Todd chimbed in a stranger's dna was found, therefore there was a stranger involved. Linda stated in one interview that indeed they are getting the bench notes, etc to question the training, protocol and accredidation of labs and the techs, etc.

Steering very far afield from Zanny the Nanny, they are going to say the state's CSI claims are unreliable, if you cannot rely on them, voila you have reasonable doubt, the kind that keeps you up at night. Can't you just see Henry Lee right now, "Something wrong"?

The defense doesn't need more funding they need a juror that just fell off the turnip truck on the ride to be sequestered in OC. All the funding in the world is not going to make the blue sky black.

"We know the crime scene has been compromised. There is nothing to link our client to the crime scene", Linda Kenney Baden said.
The evidence was ruined and spoiled, the duct tape was contaminated by the FBI. It was another person, not Casey Anthony, nor her family whose dna was found", she continued.

This list of videos would not be complete without this one. Tony clarifies with Linda that the mystery dna is really no mystery because it is a near match to one of the FBI lab workers, with the limited amount there is of it.
Also, here she goes on about the coffin flies. She is animated!!

Like them or don't the Casey team will sorely miss these two ladies, who were passionate advocates for Casey, the fact that they were pro bono, and now are gone is very very suspicious to me.

Did we ever get a full account of how the money paid to her clinic was spent?

Well we all know there were probably PLENTY of hairs, fibers and DNA in the Pontiac, but Cindy cleaned that to within an inch of her life.

I really, really hope that LE got the bags/hoses from the vacs and the trap from the drains in the garage - and that they yielded lots of evidence.

From the referenced article: http://www.orlandosentinel.com/news...ny-defense-sanctions-20101222,0,7135166.story

Ashton filed a separate response to the court order to provide information about certain expert witnesses for the prosecution. In the response, Ashton says 36 of the state's 38 expert witnesses have submitted reports or co-signed reports about their testimony and opinions.

The remaining two who have not are Christine Ballard and David Bogart.

Ballard is a graduate student working for another expert in the case. Her expertise is forensic anthroplogy. She will testify about the creation of a "video superimposition involving a photograph of Caylee Anthony in life, a photograph of her skull and a photograph of the duct tape found with her skull," the document states.

Bogart is an expert in radio frequency engineering. He will testify about the "interpretation of movement and usage patterns of the defendant's mobile phone," according to the response.

Bogart's work is similar to that of another witness, and Ashton said a report will be provided when complete.

There is a correction to the above list of (38) STATE EXPERT WITNESSES.

Remove Kristin Brewer as an EXPERT.

ADD Mark Charlesworth, Shurtape Technologies, Hickory, NC as an EXPERT.
ShurTape makes duct tape.
This witness replaces witness Thomas Achtziger.
[no Defense depo done - yet]

OT but they did not take them all down. They still have them in Virginia Beach. I got my first ticket EVER in the mail from the camera. I DID STOP for the right-hand turn-on-red but the car next to me had blacked out windows and I had to pull forward a little (over the line they have). Then I turned. But I had Connecticut plates and they said they could not prove I was violating but pay the fine or come to court. Connecticut plates, well we know court would probably not have been the option. lol

I love to read what Christine Ballard will do...they superimposed Caylee's picture on her skull and it sounds like they superimpose a picture of the duct tape on the picture. Powerful! I picture them showing her poor skull, then that coming to life with her picture, then the duct tape coming on top of that. Or some such thing.
