#McStay - Judge tells prosecutors to find the transcript of that conversation about not commenting during closings on Kavanaugh not being called. McGee interjects that he was out sick and didn't know about the ruling. "How could I violate a ruling that I didn't know about?"

What a lame excuse. He was too ill to keep up with what went on in his absence. His partners didn't tell him about judges rulings, or know about his closing argument?
 
He has to get it right though and not give Merritt possible grounds for appeal that whatever he says to the jury did not influence the jurors to find him guilty. IMO.

That’s an extremely important point, and it limits the prosecution’s options. Legally, CM can’t be punished for the misconduct of his attorneys.
 
It will be interesting to see if there are any professional complaints filed against any of the lawyers in this case afterwards. I suspect not, but will be interesting to follow afterwards :)

I do think that some of these wishy washy rulings, forgetting rulings, judge changing his mind, etc may just come back and bite someone in the bum later if there is a conviction. JMO

Let him appeal. He'll be dead long before seeing the light of day, IF he were to win an appeal that is.

So a judge’s error in favor of the defense would be a reason for the defense to appeal? I’m sure they’d have the nerve, but I don’t think it’d get anywhere.
 
I'm glad McGee pointed out the Circular arguments made by the PT. (Circular arguments have been seen around here and I did point it out at least once before.)

PT:
The family was buried on the 6th, because CM's phone pinged near the area on the 6th.
CM is the killer because his phone pinged near the gravesite when the family was buried there.

Well, there are other arguments within that explain more, it is not just circular, as you say. he has no other explanation for where he was on the 6th, when his phone pinged by the gravesite.

So why did he lie and say he was not in the desert when his phone say he was? And then his sister testified that he was at her house that day. So there are inconsistencies which point to him trying to cover up that he was there in the desert that day.

If he tells the jury to disregard what was said by McGee, how is that in favour of the defense? :confused:
 
Did they lose any rights if they just sat there and did nothing?
What rights? The prosecution don't have any rights? Good job McGee, talk about going the extra mile for your client, continue and take no prisoners.
