Judge says court documents from Planned Parenthood shooting should remain sealed

In a 116-page filing released Tuesday, Fourth Judicial District Chief Judge Gilbert Martinez told the Colorado Supreme Court that he sees no reason the details of a shooting involving Robert Lewis Dear Jr. should be unsealed. Martinez added that the media's citing of the First Amendment to access the court records is wrong and releasing details would "compromise the integrity of ongoing investigations."

On Dec. 30, Martinez ruled that unsealing certain court records would be "contrary to public interest." A media coalition that includes The Gazette petitioned the state's high court to reverse the judge's order, saying that Martinez violated the U.S. and Colorado constitutions.

State mental health evaluators need at least two more weeks to complete a report about the mental fitness of Colorado Springs Planned Parenthood shooting suspect Robert Lewis Dear Jr., a judge announced at a brief hearing Wednesday.

The report, which will help determine the next steps in the case, is expected to be complete by March 11.

Fourth Judicial District Chief Judge Gilbert Martinez scheduled a March 23 return to court to ensure the report is ready to be distributed to both sides.

The state hospital report on whether Dear is fit to stand trial won’t be finished until next month so the hearing was delayed until March 23.

The judge told him he may not. Then, as he was leaving, Dear turned to the media and said, “Come see me. I have secret case files … I’ll tell you about it. Get an exclusive.”

Last month by phone Dear called CBS4’s Rick Sallinger. He said his problems began while watching the Branch Davidian siege in Texas.

Dear claimed he’s been stalked by the FBI ever since then and he decided to make his last stand at Planned Parenthood to save babies.

Dear told Sallinger he is sane and wants to plead guilty, but that will be revealed in the state hospital’s report.

The man accused of killing three people at a Colorado Springs Planned Parenthood clinic told a woman in the parking lot that she "shouldn't have come" there that day, according to court documents released Monday.

New and bizarre details about the Nov. 27 attack and the shooting suspect were revealed after a slew of search and arrest warrants were unsealed in the case.

Long before the attack at the Colorado Springs clinic, Robert Lewis Dear Jr. harbored a respect for and fascination with violent acts against abortion providers, according to the warrants released. The deadly attack made Dear, 57, happy because his actions "ensured that no more abortions would be conducted" at the clinic, he told police.

Dear dreamed that when he "died and went to heaven, he would be met by all the aborted fetuses at the gates of heaven, and they would thank him for what he did because his actions saved the lives of other unborn fetuses," according to a search warrant.

Dear told investigators that years before the Colorado Springs attack, he once put Super Glue in all the door locks of a South Carolina abortion clinic to prevent anyone from getting inside.

On the day of the attack, Dear struggled to find the clinic. He ripped pages with information about the Planned Parenthood clinic out of phone books across Colorado Springs. Eventually, he called the clinic and asked for directions.

When Dear arrived in the parking lot, he was wearing a "homemade ballistic vest" made out of silver coins and duct tape. He was carrying four rifles, according to the warrant.

Robert Dear found not competent to stand trial for Planned Parenthood killings.
 
The admitted Planned Parenthood shooter is incompetent to stand trial, leaving his prosecution on pause while he is treated at a state hospital in Pueblo, a judge ruled Wednesday.

Robert Lewis Dear Jr., 58, will be sent to the Colorado Mental Health Institute at Pueblo to be treated for a delusional disorder - one revolving around his fears of an FBI conspiracy, Fourth Judicial District Chief Judge Gilbert Martinez ruled Wednesday.

Dear was mostly silent while Martinez read his eight-page opinion. While being led out out of the courtroom, he shouted "That's called prejudiced - prejudiced! Filthy animals!"

“The bearded, disheveled Dear, visibly angered at the ruling, called the judge “prejudiced” and a “filthy animal” as he was led out of the courtroom at the end of the 30-minute hearing.

Dear, who has proclaimed himself guilty and a “warrior for the babies” in previous courtroom outbursts, will be transported back to a state mental hospital in Pueblo, Colorado, for “restorative treatment,” and his status will be reviewed again in 90 days, on Aug. 11, the judge ordered.

Martinez cited the findings of two court-appointed state psychologists who evaluated Dear and concluded he was suffering from a psychotic delusional disorder that they said rendered him mentally unfit to stand trial.”​
 
A judge found Thursday morning that accused Planned Parenthood shooter Robert Lewis Dear Jr. remains incompetent to stand trial.

Thursday’s hearing was the first since Fourth Judicial District Chief Judge Gilbert Martinez found in May that Dear is not mentally capable of participating in and understanding the case against him. Martinez accepted psychologists’ conclusions that Dear suffers from a delusional disorder and that his delusions — which he has held for decades — include that federal agents are out to get him.

Accused Planned Parenthood shooter Robert Dear continued his pattern of courtroom outbursts Tuesday as attorneys argued over several issues related to his case in El Paso County District Court on Tuesday morning for a motions hearing.

Unlike the previous competency hearing, Dear was in the courtroom but his shouts went ignored by his defense team, prosecutors and Fourth Judicial District Chief Judge Gilbert Martinez.
