RSBM. Good question! Court approval is required. The standard for approval is the usual Constitutional standard: the plea must be voluntary, knowing, and intelligent to be accepted.

Until recently, there was debate in Colorado as to whether the trial court is Constitutionally required to make a finding that the record before her contains strong evidence of actual guilt. The core argument for such a rule was expressed by Professor Lucian Dervan in 2012:

"Today, defendants whose guilt is uncertain are offered plea bargains as often, if not more often, than those for whom the evidence is particularly strong, Not only are these defendants of questionable guilt offered plea bargains, their bargains are often more generous and, therefore, more irresistible than those offered to defendants against whom the government believes it has a strong chance of success at trial."

Here's an interesting article describing the oral arguments in the Colorado Supreme Court. The case is Medina v. Colorado.

Ultimately, the Colorado Supreme Court held that a defendant may enter an Alford plea while nonetheless waiving the establishment of a factual basis for the charge under the CRCP, provided that the plea is voluntary, knowing, and intelligent. The trial court may, in its discretion, engage in an inquiry as to whether there is a factual basis for the plea, and in some cases it may be the best practice to do so, but such an inquiry is a procedural tool to assess whether the plea is voluntary, knowing, and intelligent.

But I could picture Melinda agreeing with such. Putting the girls first and saying it’s the best scenario for them.

The case against BM is charged as "The People of Colorado v Barry Morphew," and the parties here (DA and Judge) are all elected by the People.

I don't believe a grand jury would have Indicted BM for first-degree murder without probable cause-- finding sufficient evidence for the case to proceed to trial.

Seriously, an Alford Plea, 2nd degree, 4 years, out in 2? This is complete nonsense! These types of proposals are exactly when a Judge cites:

“I am not accepting that plea agreement,” adding, “It doesn’t serve the interests of justice.” And then stalks out of the courtroom.

I agree!

Colorado judges have the right to reject a plea agreement as unjust, and have done so for a variety of reasons. It's rare, but it happens.

Here's an article from a well known Colorado defense attorney describing the factors Colorado judges have in mind when they consider the justice aspect of a plea agreement.

I just saw this. Did we know she was moved twice? If so, please ignore. 😃

I happen to think he moved her multiple times, several times the first night (PP to beach site to construction site to PP again), but I think the article means she was killed at home, placed somewhere, then moved to Moffat, and they're counting that as twice moved.

Why was her body moved? No idea, an extremely risky move
Why Bleached bones?
My thoughts ;
-House and hotel room smelled of bleach, but that would be no reason to move her, however the timeframe of last proof of life? 4pm ish(?) She may have been bleached in the cooler and buried once.
- And unlikely as BM said to MG the next day, ‘I could bury a body and no one would ever find it’.
-bones exposed to elements , to risky

Good question! Typically, an indictment is amended to add charges via a superseding indictment issued by the grand jury, not by motion.

However, after 5 years the statute of limitations (3 years from date of offense, for most felonies) may have expired on some or all potential charges.

IMO, this reference by BM thinking he'd be free because body found -- as retold by Jane, must be a foreign/Danish word referring to SM being found(??).

As I recall, and this may not be accurate (seeking source) GD (?) use to go over to the house when BM was away, and only SM was there.

Tried to find this online, could not find a consistent answer. Due to the nature of my searches, I fully expect LE to come knocking at my door soon.
A scenario -BM places SM body in a cooler of bleach, this would whiten bones, dissolve hair. How long would this take?The house and hotel room stank of bleach.
Would that plausibly rule out moving her body a second time? MOO. I just cant wrap my head around BM moving the body. It is far to risky.
Did BM car data show BM car driving in the direction of where the body was found? MOO

yes, it would. However last proof of life was at approx. 2pm. and we know BM was well on the road before 5am. If her body was soaked in bleach and she was buried in this condition, would this bleach her bones?

At some point, he did not have her remains contained. Her feet didn't walk off.

No evidence of predation on the bones so it's just got to be the case that something organic occurred, accounting for incomplete remains, something Barry couldn't find/fix.

Ice/water/mountain stream is the only thing that makes sense to me.

Barry must have decided that it would bolster his narrative to have Suzanne's remains found in the Boneyard, so much so he was willing to risk moving her. He had to have been aware that bones were missing...

I hope the trial sheds light on the timing of these events.

It's such a disgrace.

I think that it is highly unlikely that Suzanne would be interested in someone who was a close friend of Barry's and more than likely shared the same boorish attitudes towards women. I believe she began another relationship out of pure loneliness and the need to connect with someone from her past on an emotional and intellectual level . This obviously developed overtime and did become physical on the few occasions they met up. I do not believe Suzanne would be interested in a clandestine physical affair with one of Barry's friends.
I can believe that GD might have tried his luck ,but have been quickly rebuffed.
Or that he was willing to make up things aided and abetted by others in order to smear Suzanne's character and try and create a scenario whereby she had numerous affairs and one of those men was responsible for her murder.
