I recall a discussion where, unless more than a few minutes has lapsed in between texts, the phone will not display a time stamp for each. It assumes a "conversation" is going on. With more than a few minutes delay (see the 15 min delay between 745 and 801 as an example, a new time stamp will appear. For this reason, II assume that last flurry of texts happened all very close to 8:01 and was over by 8:05 at the latest.

Going by that, DR must have told him he couldn't go that night by 6:45 or so.

I agree. He would have said 'ok' or something similar to acknowledge that he understood what R was telling him to do once he got there.

Also, why didn't Dylan answer R's text from Monday morning? Even if he wasn't going with his dad, I think he would have texted R and told him he would be there later. Or why didn't he text R when he was eating cereal and watching Nick? This is a 13 year old; his Mom said he was always texting and him and R had been texting all day on Sunday.

I still do not believe that Dylan was ever at his dad's house. I also do not think the dogs ever picked up his scent from around his dad's house....jmo

But then what would they lock him up for, in other words, can he be charged with something IF Dylan didn't make it there? I would think they may need more ... but I don't know...

I think they cannot confirm either way.
Lack of evidence is not evidence, I guess.

I disagree (respectfully). By the time they did the thorough search of the home 2 weeks had passed. I think a defense attorney would have a field day with that. Even if they caught MR in a lie, I don't think that alone would be enough to prove murder.

I think that's why there's so many possible scenarios. You have to go back to the last known fact. Wal Mart is a fact. The 8:01 +/- is a fact because I believe they can prove that via phone company records. Other than that - everything from that point on is pure speculation until something more comes out.

well, there was the cereal bowl and the tv was on. also, the pants.

but that is Mark's story and right now I don't think he is telling the "whole" story; jmo....

and Dylan was there is September, so the pants could have been left then.

IF MR did something to Dylan before getting home he could have easily pulled a pair of Dylan's pants out of the backpack to take home as 'proof' that he was there. That means nothing if you ask me. The cereal bowl? I highly doubt that sat on the counter for 2 weeks unwashed. And the TV being on...well who knows on that one. No way to prove that one way or the other.

When he texts that he will call R all day, that sounds sad to me now. He sounds like he really wanted to go and see his friend. I feel like he would have closed out the conversation in some way.

IA. LE already knows whether Dylan was at the house that night or not. And interestingly, Elaine has never said she didn't think her son made it there that night. I'm thinking if she knew he hadn't, she would have voiced that in one of her interviews. JMO.

And I think if LE already has the answer to whether Dylan was at Mark's house or not, Mark would already have been arrested, because let's face it, that's a biggie, if that's a lie, that's the smoking gun. Maybe he'd be out of bail but he would have had charges filed by now. Had Dylan never made it to the house, the buck stopped with Mark, then and there.

Thank you. I really, really want to see the whole Walmart tape - coming in, leaving, Mark.....grocery cart....vehicle.....for some reason LE doesn't want to release all the tapes, jmo

Mark would also have had to turn off or take the battery out of his cell phone so it wouldn't ping his location. And if he has XM radio in his vehicle, satellite will tell LE where that vehicle was that night or if it stopped. If the vehicle had OnStar or a GPS of some sort, same thing. If this was a crime of passion, Mark flipping in an instant, none of that would have been thought of.

So perhaps, LE have the answers to this question already, which is why there hasn't been an arrest. MOO

I don't think there was any way for LE to determine if Dylan was ever at that house or not. Especially 2 weeks after the fact.

Well I don't have XM radio and know very few people that do. I don't have OnStar and know very few people that do.

You're ASSUMING none of that would have been thought of.

I do have a smart phone with GPS but we don't know if MR did or not.

Oh gosh that's a long story but the short story is Mark hung around the house making noise trying to stir Dylan from his sleep and when he couldn't he eventually left at 7:30.

Another odd fact in this story.

I can also ASSUME that IF MR were going straight to Durango he would have a shorter drive since he didn't have to go to Bayfield first. That could account for him leaving later but this was quite a bit later. If Dylan was going to arrive around 6:30am in Bayfield they would have had to of left the house by about 6:00-6:10.

I agree and how long after he was reported missing did LE go to MR's. Was it that night? Oh no, I just thought of something. If the texts that R made to DR on Monday re: that his dad was looking for him and his mother was worried, why aren't texts from MR there or ER, or anyone? Or maybe the transcript isn't a complete compliation of all the phone activity that day. Just what was between the phone and R. But, why not have the whole call/text history. Does that make sense to anyone? tia
