In small towns, it's common for LE to hang around school activities, proms, dances, baseball games, wrestling matches, etc. A ) to keep an eye on things and B ) there's little else to do in a quiet community. Supposing this guy hung around the school activities a lot and got to be chatty with the youngsters? Parents would see it and think ' oh great, it's so nice to have the local LE hanging around our kids and keeping us safe :) " .. Right? Ugh !

I wonder how well this guy knows MR's neighbor. He could be one of the sources of the pictures they found. MOO

This really bothers me, also. I can't help but wonder if there is a connection - but.... I would think that the other guy would have been arrested also, right? Because if there is a connection - it would be "new" stuff, not from the stuff that other RSO was busted for? I can't remember exactly - but wasn't the RSO busted in 2005 or something?

How and When to Appeal a Custody Case in the State of Colorado

Divorce and child custody cases are subject to the same appeal rules as all other civil cases. An appeal is brought because you think the judge made a mistake or misapplied the law. Simply not being happy with the outcome is not a basis for an appeal.

In the State of Colorado, you have the right to appeal the decision of a district court judge to the Court of Appeals and file a Notice of Appeal within 45 days of the Judge's ruling. Appeals are costly and lawyers usually require a payment of $7500 before they will accept the case. The case can take a year or more and the Supreme Court does not take overturning a District Court decision lightly.

Unless there is something concrete to base an appeal on, it would probably be futile however you can always file a Complaint to modify an order anytime you have the required compelling change in circumstances with either party or the child.

It is best to contact an attorney familiar with family law matters and appellate law to discuss your options.

Hi - I have not been on in ages . I can see that Dylan is still missing and its a shame the thread is attracting less and less people as it used to be so active .

I am just wondering has Mark done anything recently in helping find Dylan ?

Have there been any new interviews by the family ?

Nothing has changed or happened in a long while. Seems to be still a little too soon for the lake to be searched again, at least as far as we know. Nothing much new to talk about, really.

So, this Deputy was arrested, how long can they hold him before they have to file charges in Colorado?

Thank You , i just can not believe it has been going on for over 4 months . And it is looking less and less likely the person/persons responsible will be brought to justice .

Five months next week. And we hardly ever hear a word about him from LE.

I'm trying to catch up a bit... So, besides the vicinity, and working with the LPCSO, what solid proof is there that might tie the Deputy to DR's case? If I'm correct the deputy was arrested on charges of child 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬?

I'm just keeping in mind that collectors of child 🤬🤬🤬🤬 wouldn't necessarily be involved in kidnapping/murder (if DR really is gone). There are different types of these criminals, and the term pedophilia is a term that is really overused in our society - we tend to group many different kinds of perpetrators under that title that aren't technically pedophiles. I have to go and read the articles, but was there a specific "type" referred to as to what kind of subjects were in the 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬?

It's sick that there was someone in law enforcement that is alleged to have committed crimes like this. I'm glad that it came to light, and it's being dealt with. I just have to wonder why people are suggesting that because this person was arrested that they had something to do with DR's disappearance.

Colorado Revised Statute 18-6-403

(3) A person commits sexual exploitation of a child if, for any purpose, he or she knowingly:

(a) Causes, induces, entices, or permits a child to engage in, or be used for, any explicit sexual conduct for the making of any sexually exploitative material; or

(b) Prepares, arranges for, publishes, including but not limited to publishing through digital or electronic means, produces, promotes, makes, sells, finances, offers, exhibits, advertises, deals in, or distributes, including but not limited to distributing through digital or electronic means, any sexually exploitative material; or

(b.5) Possesses or controls any sexually exploitative material for any purpose; except that this paragraph (b.5) does not apply to peace officers or court personnel in the performance of their official duties, nor does it apply to physicians, psychologists, therapists, or social workers, so long as such persons are licensed in the state of Colorado and the persons possess such materials in the course of a bona fide treatment or evaluation program at the treatment or evaluation site; or

(c) Possesses with the intent to deal in, sell, or distribute, including but not limited to distributing through digital or electronic means, any sexually exploitative material; or

(d) Causes, induces, entices, or permits a child to engage in, or be used for, any explicit sexual conduct for the purpose of producing a performance.

(4) (Deleted by amendment, L. 2003, p. 1882, § 1, effective July 1, 2003.)

(5) (a) Except as provided in paragraph (b) of this subsection (5), sexual exploitation of a child is a class 3 felony.

(b) Sexual exploitation of a child by possession of sexually exploitative material pursuant to paragraph (b.5) of subsection (3) of this section is a class 6 felony; except that said offense is a class 4 felony if:

(I) It is a second or subsequent offense; or

(II) The possession is of a video, video tape, or motion picture or more than twenty different items qualifying as sexually exploitative material.

I'd say this fits in as a Someone Else Did It, possibly Someone Dylan Knew. Could be coincidental, Dylan outside and seen by the deputy, offered a ride, etc.

Or could be prearranged meeting? That seems a bit more of a stretch as I think LE would have known of it by finding communication records between the deputy and Dylan. Perhaps the 9:37 text, but I would think that if the deputy and Dylan had been exchanging texts Sunday night, LE would have acted on that already.

So my opinion is that if the deputy were in anyway involved, we have the same issues we did with any other "someone saw Dylan outside and got him into the vehicle" theory - no contact with anyone on Monday and no sign of Dylan's backpack or other belongings.

I'm very glad this person has been picked up. One less unknown SO in the area.

I'm surprised that this deputy was caught doing something illegal in the first place. With his LE training I would think that he would have done a better job of covering his tracks.

If he is connected to Dylan's disappearance I hope that he did leave a trail of evidence that LE can follow. MOO.

I agree with you Redhead72. There was a family that was almost completely destroyed here in AZ a few years ago, a photo processor reported them to police, they were arrested for child 🤬🤬🤬🤬. The pictures were pictures of their kids (little ones) playing in the bathtub. There was NOTHING wrong or sexual about them. On the other hand, there have been some resource officers that have gotten into some sticky situations with high school girls and texting / sexting. Child 🤬🤬🤬🤬 sadly blankets a lot of things. :(

This La Plata County deputy being arrested for suspected possession of child 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬 is no minor thing. I think it's important to note that there are only approximately 50,000 people in the whole of La Plata county. This is not a heavily populated area. The arrest of LE officer in say Cook County, Illinois where the population is over 5,000,000 is easy to dismiss quickly. This one, not so much.

I don't know, but I do know this, she should call 911 immediately if she sees him again. If she can take a picture unobtrusively, that would be extremely helpful, but should not come before calling and attempting to observe direction of travel or anything else that would help LE find the man and boy she saw.

I took a quick look in the Media/Timeline thread and it looks like Dan Bender, the PIO for La Plata County SO, has at least giving monthly press releases.

While these PR's don't have a lot of information in them, at least LPCSO is being consistent in releasing something on a monthly basis. Maybe we will get another PR soon.

Yeah, I don't have much faith in the so-called sighting in CA. I doubt very much a man would not only have a kidnapped boy out in public, but would do anything to create a scene or attract attention. And Dylan would be fourteen, not likely to be easily thrown over a shoulder and carried off. It just sounds too out there for me.

I found this. CO may be less than 72 hrs. I haven't found it specifically.

As a general rule, however, if you are placed in custody, your "speedy trial" rights require the prosecutor to decide within 72 hours which charges, if any, will be filed. Many states adhere to this 72 hour limit, but other states, such as California, go further and require that the decision be made within 48 hours after someone is taken into custody.
