Technical question:

Not guilty by reason of insanity...

Will the jury be charged first with determining whether they believe she's sane or insane (or was at the time in question) and that's it? If she was insane, she's not guilty. If she was sane, she's guilty.

Then the judge sentences? If she's NGRI, he can remand her to treatment? Indefinitely? Until such a time as she's deemed not insane?

I am so grateful for her back-to-the camera interview, the one she solicited. Standing in front of the uhaul in which she'd haul his remains to Florida. BSC but lucid. Coherent (if ludicrous). Testifying to the world that she wasn't one whit insane, just the whole bank of lay crazy.

Yes they have there jury faster then I thought judge Warner is good. I'm anxious about the jury I hope they see things like we do. The ngri bothers me she's evil not insane jmoo mvho

I think we had a good preview of how the jury pool understands and/or feels about an NGRI defense. IMO, LS will not be given a pass. Jurors selected will hear the experts but unlike other jurisdictions, in Colorado, the burden rests on the prosecution to prove beyond reasonable doubt that LS was not insane when she murdered Gannon.

COLORADO SPRINGS, Colo. (WBTW) — A jury of 11 men and seven women in Colorado Springs, Colorado, is set to begin hearing opening arguments Monday afternoon in the trial of a former Horry County teacher accused of killing her 11-year-old stepson.

Letecia Stauch is on trial for allegedly killing her stepson Gannon in early 2020. She was arrested in Myrtle Beach in March 2020 and extradited to Colorado, where she is charged with first-degree murder; child abuse resulting in death; tampering with a deceased human body; tampering with physical evidence, eight counts of crime of violence; and attempted escape.

Jury selection for the case began on March 20.

A last-minute defense motion to eliminate the public viewing of the proceedings (via WebEx) (change venue?) is denied by Judge Werner.

The Court cited Dylan Redwine and James Holmes cases where the public interest in the trial did not impact the defendant receiving a fair trial.

LS also agreed that the jury will decide her fate and this will not be a bench trial (decision by the Court).

Judge brings the jurors back inside the courtroom for additional instructions on how and where to enter the courtroom and wear their badges. (Judge forgot to make this announcement before recess).

Advising jurors they are allowed to ask questions of the witnesses and they can take notes during the trial -- it's entirely up to the juror. Jurors determine the credibility of the witness.

There will be both circumstantial and direct evidence in this case and both are given equal weight under the law.

Jurors can wear jackets in the courtroom if they are cold. Drinks are allowed in the courtroom but no food.

Jurors are again dismissed until 1:30 PM.

I'm not worried. This has been 3 years in the making, the jury know she did it and imo it won't take them long to decide she is legally sane. She knows she is done.

She knows she ain't convincing those 18 people of anything. She is out of time and out of ideas. She knows what evidence they will be shown and they can say they can be impartial until the cows come home, but they all have an opinion already and that evidence will only confirm it for them IMO.
