I don't think he is going home anytime soon! Won't he have to be on the stand during the whole 22 hours...then his cross examination???

I wonder if his contract was setup that he could not cash his check until after his testimony that JH was sane.

He sure seemed awful anxious to get to the point. I think that approach lost a little credibility with me. If I was a juror, I would have liked to have listened to some foundation remarks before he stated that so quickly.

Or at least add that in the days to come you will plainly see how my analysis of the defendent showed he was sane enough to know right from wrong.

It just seemed so rushed. Kinda strange to me.

I honestly think maybe his check was tied to his testimony and he had to get that out in order to cash it.

I may have to do some research into "hired guns" and their pay arrangements. I honestly wonder if that is why he rushed that out so fast.

Do you believe any expert who testifies is a "hired gun"? Should this man not be paid for his work?

the only thing I can think of that would be a problem is penalty phase.....

Isnt this case a little different because I thought with the Insanity Plea the defense made that his penalty is already going to be decided based on whether the jury agrees with insanity defense or not.

Like if Jury agrees with defense, then wont he automatically be committed to a medical facility?

If the jury agrees with the Prosecution, then would he automatically get the DP?

Maybe not as I am not sure how it works with the insanity defense plea?

He was hired by the Judge. Not the PT or DT. He performed his duties a year or whatever ago, when he went through his examination of JH. Now he is testifying.

Unless they are still practicing in their normal practice and somehow got dragged into a trial by accidental association, then yes I tend to assume they are "hired guns".

It doesnt mean I do or dont believe what they will say. Will have to wait and see what this guy has to say because he has not said much yet except his deduction was that JH was sane and he gave no basis for that statement yet. He has not said how he came to conclude that. Will have to wait and see what more he says before deciding about him.

I agree the judge hired him for the state for his services which he already provided, but I believe that concluded already. My understanding is that either side could have pursued him to get him to testify for their side of this case. So I am not convinced he is not also being paid by the prosecution for his testimony.

Maybe there is some kind of clause when the state hired him for his analysis that prevents either side from paying him money. Maybe his original contract had it all worked out about any future funds for testimony.

Judge just said that the docs answer was 'unresponsive'. He didn't give an answer to what the prosecutor asked. Little confusing but defense is going to pick at everything, just like they did the survivors.
